MESSAGE FROM THE HOUSE OF DELEGATES

The Chief Clerk of the House of Delegates appeared and delivered the following message:

House Bills vetoed by the Governor and not sustained by the House.

House Bill No. 770—Dump Trucks

An Act to repeal and re-enact, with amendments, Section 81(f)(2) of Article 661/2 of the Annotated Code of Maryland (1967 Replacement Volume and 1967 Supplement), title "Motor Vehicles" subtitle "Administration—Registration—Titling" to remove the provisions from the Article on "Motor Vehicles" that a vehicle registered for "dump service" plates be subject to all restrictions of said Article if such vehicle is being operated for the hauling of loose materials in bulk beyond a radius of forty (40) miles or for the hauling of materials other than loose materials in bulk, RELATING TO THE SPEED OF SUCH VEHICLES.

Annapolis, Maryland Dear Mr. Speaker:

In accordance with Section 17 of Article II of the Maryland Constitution, I have today vetoed House Bill 770.

This bill removes the 35 mile maximum speed limit now imposed on loaded "dump trucks." These vehicles under current law are authorized to haul maximum weights of 40,000 pounds on 2 axles and 65,000 on 3 or more axles. Their very short wheel base for the load carried, of necessity, creates an extreme hazard at high speeds. In the event of brake failure or loss of control, the possibility of serious or even fatal accidents will be greatly increased at higher rates of speed. The relinquishing of the existing controls on the speed of these vehicles would not be compatible with present steps being taken to improve and promote traffic safety on our highways.

For the above reasons, I am compelled to veto this measure.
