39. County Superintendent.

The county superintendent of schools shall be the executive officer,
the secretary, and treasurer of the county board of education, but
shall not be deemed a public officer under the constitution or the laws
of this State. He, or his designated representative, shall attend all
meetings of the board and of its committees, except when his own
tenure, salary, or the administration of his office are under considera-
tion and shall have the right to advise on any question under con-
sideration, but shall have no right to vote.

40. Boards to maintain school systems.

The county boards of education are authorized, empowered,
directed, and required to maintain throughout their respective polit-
ical subdivisions a reasonably uniform system of public schools
designed to provide an adequate educational program

for all youth.

41. Duties in general.

The county board of education shall to the best of its ability cause
the provisions of this Article, the bylaws, rules and regulations,
and the policies of the State Board of Education to be carried into
effect. Subject to this Article, and to the bylaws, rules and regula-
tions of the State Board of Education, the county board of education
shall determine, with the advice of the county superintendent, the
educational policies of the county school system and shall prescribe
rules and regulations for the conduct and management of the public
schools in the said county school system. Such rules and regulations
shall be codified and made available to the public.

42. Establishment and control.

The county boards of education shall have authority to establish
public schools when, in their judgment, it is advisable to do so, subject
to the approval of the State Superintendent of Schools, according
to the bylaws, rules and regulations of the State Board of Education.
Upon approval by the State Superintendent of Schools, any elemen-
tary or high school, or any school or combination of any grades
thereof, so established, shall become a part of the State foundation
program of public education as provided for elsewhere in this
Article. The county board of education, with the advice of the
superintendent of schools, shall determine the geographical attend-
ance areas for all such schools established under the provisions of
this section.

43. Schools for adults.

The county boards of education, in accordance with the rules and
regulations of the State Board of Education, may establish and
maintain day and evening schools for adults, the purpose of which
shall be to provide a general program of continuing education in all
its aspects for the improvement of the civic, vocational, and general
intelligence of adults, and to enable them to make a wise use of their
leis
