61.

(d) (1) For the protection of the people of this State, [it shall be
the duty of] the Department [not] may refuse to grant a license to
any person as a dealer, used car dealer, motorcycle dealer, or trailer
dealer, [nor shall it continue] or may suspend, revoke or refuse to
continue
a license of a dealer, used car dealer, motorcycle dealer, or
trailer dealer already issued, where the Department finds that:

(i) The person, management personnel of the dealer, used car
dealer, motorcycle dealer, or trailer dealer, or any other person
who shall have a financial interest, whether direct or indirect, in
such business, are untrustworthy, lack competence or has been con-
victed by final judgment in any state or federal court of a crime of
moral turpitude.

(ii) The vehicle sales transactions of the person have been marked
by a practice of failure to perform contracts, or

(iii) By fraud or bad faith.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.

(House Bill 520)

AN ACT to repeal and re-enact, with amendments, Section 253(d)
of Article 66½ of the Annotated Code of Maryland (1968 Supple-
ment), title "Motor Vehicles," subtitle "Operation of Vehicles

RELATING GENERALLY TO THE LOADING OF TRUCKS.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 253(d) of Article 66½ of the Annotated Code of Mary-
land (1968 Supplement), title "Motor Vehicles," subtitle "Operation
of Vehicles Upon Highways," be and it is hereby repealed and
re-enacted, with amendments, to read as follows:

253.

(d) All trucks operating on highways shall be loaded in such a
manner that reasonable care shall be taken to prevent the load or any
part thereof from BLOWING, falling or spilling upon the highway,
[in such manner as to create a traffic hazard or public nuisance.] It
shall be unlawful for a person or the persons responsible for construc-
tion or excavation work to permit materials, dirt or debris to be loaded
in such a manner that the load or any part thereof shall BLOW, fall or
spill upon a public street or highway. Further, should materials,
dirt, or debris be so deposited upon a public street or highway, the
person, persons, firm or corporation responsible for the construction
or excavation work shall promptly provide necessary personnel to
remove same from the street or highway immediately adjacent to
