CHAPTER 294
(House Bill 384)

AN ACT to repeal and re-enact, with amendments, Section 41 of
Article 88A of the Annotated Code of Maryland (1964 Replace-
ment Volume), title "State Department of Public Welfare SOCIAL
SERVICES," subtitle "Volunteer Firemen," to provide for the
payment of the sum of two thousand dollars ($2000) from the
Treasury of the Maryland State Firemen's Association to the
surviving widow, or minor child or children, or if there be no
surviving widow, OR MINOR CHILD OR CHILDREN, to a parent
or parents, sister or sisters, brother or brothers who were de-
pendent upon any volunteer fireman who dies as a direct result
of the act of participating in fighting a fire or while going to or
from a fire or performing any other duties necessary to the opera-
tion or maintenance of the fire company or actively participating
in ambulance or rescue work , AND TO CHANGE THE AGE
TO WHICH PAYMENTS MAY BE MADE.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 41 of Article 88A of the Annotated Code of Maryland
(1964 Replacement Volume), title "State Department of Public
Welfare
SOCIAL SERVICES," subtitle "Volunteer Firemen," be
and it is hereby repealed and re-enacted, with amendments, to read
as follows:

41.

In case of the death of any volunteer firemen [by accident re-
sulting from] as a direct result of the active participation in fight-
ing a fire or while going to or from a fire, or performing any other
duties necessary to the operation or maintenance of the fire com-
pany or actively participating in the ambulance or rescue work of
an incorporated volunteer fire company in the State of Maryland,
[and] who leaves a widow, or minor child or children; or if he
leaves no widow or minor child or children, but leaves a parent or
parents, or a sister or brother, who were dependent upon him for
support, there shall be paid to said widow, or to the guardian of said
minor child or children, or the surviving parent or parents or sister
or brother so dependent upon him for support, the sum of two
thousand dollars ($2000) from the Treasury of the Maryland State
Firemen's Association; provided further that if
he leaves a widow
or a dependent child or children, the case shall be laid before the
board of trustees of the Maryland State Firemen's Association, and
if the facts are established as provided in Section 40, the widow and
child, or children as the case may be, shall be placed on said "Dis-
abled Firemen's List," and the widow shall be entitled to receive a
pension from the Maryland State Firemen's Association in a sum,
the amount of which shall be decided upon by the board of trustees
of the Maryland State Firemen's Association, and to be paid out
of its treasury at such times and in such installments and in such
amount as the said board of trustees of the Maryland State Fire-
men's Association may decide, during widowhood, and each of the
chil
