with the time and place of such public hearing, shall be published
once or more, if the commission deems best, in a weekly or daily
newspaper in general circulation in such city and county. When such
regulations are adopted by the council, a copy thereof shall be certi-
fied by the commission to the county clerk of the county in which
the municipality and territory are located for record.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.

CHAPTER 221
(Senate Bill 349)

AN ACT to repeal and re-enact, with amendments, Section 13B of
Article 66C of the Annotated Code of Maryland (1967 Replace-
ment Volume), title "Natural Resources," subtitle "Department of
Chesapeake Bay Affairs," to require persons dredging oyster shells
UNDER THE WATERS OF THE CHESAPEAKE BAY AND
THE POTOMAC RIVER to leave a certain portion of the bottom
untouched.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 13B of Article 66C of the Annotated Code of Maryland
(1967 Replacement Volume), title "Natural Resources," subtitle "De-
partment of Chesapeake Bay Affairs," be and the same is hereby re-
pealed and re-enacted, with amendments, to read as follows:

13B.

(a)  Any person, firm, association or corporation desiring permis-
sion to extract sand, gravel, rare earth, minerals, or any other re-
sources from the public lands under the public navigable waters of
the Chesapeake Bay (not including tributaries and estuaries of the
Bay) AND THE POTOMAC RIVER must make application there-
fore to the Department describing the location of the land under
the public navigable waters of the Chesapeake Bay AND THE
POTOMAC RIVER from which such resources are to be recovered,
where possible by stakes driven at definite corners, or otherwise, so
as to make practicable the survey of such land as provided for in
Section 26 of this Article. The application shall be accompanied by a
filing fee of ten dollars ($10.00). The Department shall receive and
review such application and grant a permit if deemed in the best
interest of the State.

(b)  Persons dredging oyster shells from the public lands under
the navigable waters of the Chesapeake Bay
AND THE POTOMAC
RIVER shall leave APPROXIMATELY one hundred feet of bottom
untouched for every one thousand feet dredged. These
APPROXI-
MATELY one hundred feet areas shall be left so as to constitute
strips, which shall be located across the tide. These strips shall be
maintained and no persons may destroy or damage them by dredg-
ing or other means. These provisions shall not apply to the taking
of oysters as governed by Sections 696 through 717 of this Article.
