designated as provided in subsection (a) above, and not on his or
her own behalf.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.

CHAPTER 209
(Senate Bill 206)

AN ACT to repeal and re-enact, with amendments, Sections 78 (e),
78 (f), 128, 130D, 144A and 233 (b) of Article 56 of the Annotated
Code of Maryland (1968 Replacement Volume and 1968 Supple-
ment), title "Licenses," subtitles "Private Detectives," "Horse
Riding and Rental Stables," "Motor Vehicle Fuel Tax," and "Real
Estate Brokers," amending the license laws of this State in order to
make certain corrections in the language and references of these
laws.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 78 (e), 78 (f), 128, 130D, 144A and 233 (b) of Article
56 of the Annotated Code of Maryland (1968 Replacement Volume
and 1968 Supplement), title "Licenses." subtitles "Private Detec-
tives," "Horse Riding and Rental Stables," "Motor Vehicle Fuel
Tax," and "Real Estate Brokers," be and the same is hereby repealed
and re-enacted, with amendments, to read as follows:

78.

[(e) Any person, firm, association, or corporation to whom a li-
cense may be issued in accordance with this subtitle shall surrender
such license and all duplicate copies thereof to the Superintendent

within five days after such license shall have expired or shall have

been revoked, suspended, or surrendered.]

[(f)] (e) The Superintendent shall not issue a license to an appli-
cant whose trade name, trademark or fictitious name is so similar
to that of a trade name, trademark or fictitious name used by any
other licensee, that the public may be confused or misled thereby.

128.

The following words and phrases when used in this [section]
subtitle shall be construed as follows:

(1)   "Person" shall include any individual, firm, copartnership,
association or corporation.

(2)   "Horse riding and rental stables" shall mean any establish-
ment in connection with which one or more horses or ponies are
let for hire to be ridden or driven, either with or without the fur-
nishing of riding or driving instruction.

(3)  "Horse" shall include both horses and ponies.
