and regulations to prevent an abuse of this section by the granting
of unnecessary and unwarranted overtime or by the failure to grant
overtime compensation when the employee is eligible to receive the
same under the provisions of this section. Any employee who is
designated by his executive head as [being not subject to the provi-
sions of a forty hour week], a supervisory employee shall have the
right to appeal to the State Commissioner of Personnel, who shall
investigate and decide such employee's appeal, and the Commis-
sioner's decision shall be final and binding upon both the executive
head and the employee who appeals such designation.

(c) Provided, however, that the provisions of this section shall
not apply to the law enforcement personnel of the Game and Inland
Fish Commission, Department of Forests and Parks, The Depart-
ment of Chesapeake Bay Affairs, The Maryland Alcohol Tax En-
forcement Unit and The Department of Maryland State Police.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.

CHAPTER 168
(House Bill 1301)

AN ACT to add new Section 11(17) to Article 73B of the Annotated
Code of Maryland (1967 Replacement Volume and 1968 Supple-
ment), title "Pensions," subtitle "In General," to follow immedi-
ately after Section 11(16) thereof; and to add new Section 113
(12) to Article 77 of the said Code (1965 Replacement Volume
and 1968 Supplement), title "Public Education," subtitle "Chap-
ter 8. Teachers' Certificates, Salaries and Pensions," subheading
"Teachers' Retirement System," to follow immediately after Sec-
tion 113(11) thereof; to provide for an increase in the amount
of pension received by retired State employees and teachers and
to specify the method of computing such additional pension pay-
ment.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 11(17) be and it is hereby added to Article 73B
of the Annotated Code of Maryland (1967 Replacement Volume and
1968 Supplement), title "Pensions," subtitle "In General," to follow
immediately after Section 11(16) thereof and to read as follows:

11.

(17) Any person on July 1, 1969, who is receiving a retirement
allowance as an employee as this word is defined in Section 1(3)
of this Article or who is receiving such an allowance as the bene-
ficiary of such a person shall receive an additional amount as pro-
vided herein. The additional amount shall be equal to one-sixth of
the total sum represented by the retirement allowance payable tinder
this Article and any supplementary payment received under the
provisions of Section 14(7) of this Article after any reduction made
