CHAPTER 163
(House Bill 1306)

AN ACT to repeal and re-enact, with amendments, Sections 29(a)
and (c) of Article 66˝ of the Annotated Code of Maryland (1957
Edition and 1967 Replacement Volume), title "Motor Vehicles,"
subtitle "Administration—Registration—Titling," to provide for
an increase of one percent in the excise tax levied for certificate
of title for motor vehicles, and providing that the additional
sums collected as a result of said increase be added to the general
funds of the State of Maryland, and relating generally to the motor
vehicle excise tax in Maryland.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 29(a) and (c) of Article 66˝ of the Annotated Code
of Maryland (1957 Edition and 1967 Replacement Volume), title
"Motor Vehicles," subtitle "Administration—Registration—Ti-
tling," be and they are hereby repealed and re-enacted, with amend-
ments, to read as follows:

29.

(a) In addition to the charges prescribed by this article there is
hereby levied and imposed an excise tax for the issuance of every
original certificate of title for motor vehicles and commercial motor
vehicles, in this State and for the issuance of every subsequent
certificate of title for such motor vehicles and commercial motor
vehicles in this State, excluding house and office trailers; motor
vehicles transferred to members of the immediate family, when there
is no money or other valuable consideration involved in the transfer;
motor vehicles repossessed under a lien contract except where the
sale of the motor vehicle is required under the contract; motor
vehicles being transferred to a legal heir, legatee, or distributee;
and transfers of any motor vehicles exempted from the payment of
the excise tax under Section 29(d) and other applicable sections of
the Annotated Code of Maryland, and the Department of Motor Vehi-
cles shall collect said tax upon the issuance of every such certificate
of title of a motor vehicle at the rate of [three] four per centum
of the fair market value of every such motor vehicle or commercial
motor vehicle, excluding, those transfers previously exempted in this
section for which such certificate of title is applied for and issued.

(c) The Department of Motor Vehicles shall remit all sums
collected under the provisions of this section to the State Treasurer,
who shall transfer and credit 25% thereof to the general funds of the
State and shall then
use and apply the [same] remainder thereof,
first, to the extent required for debt service on any outstanding
State highway construction bonds and shall transfer the balance
thereof, if any, to the construction fund for the State Roads Com-
mission provided by Section 32 (e) of said Article 89B.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1969.
