35. 34. Operation of transit facilities.

The Authority may operate the transit facilities owned or con-
trolled by it, whether such control is by ownership, lease or other
arrangement, or may provide for the operation of such transit facil-
ities, in whole or in part, by contract, lease or other arrangement.

36. 35. Inadequacy of bus service by private carriers; subsidy pay-
ments.

In any situation in which the Public Service Commission is un-
able, through the exercise of its regulatory powers over private
carriers, or, upon request by the Authority, fails or refuses to direct
a private carrier to perform a service specified by the Authority, the
Authority is authorized to perform such transit service by transit
facilities owned or controlled by it as it may deem necessary to pro-
vide adequate transit service. In any such situation, the Authority,
in order to encourage private carriers to render bus service to the
fullest extent practicable, may, pursuant to agreement, make reason-
able subsidy payments to any private carrier.

37. 36. Acquisition of transit facilities by OF private carrier.

(a) When and How transit facilities may be acquired. Notwith-
standing any provision herein to the contrary, when any private
carrier is unwilling or unable to coordinate and integrate the service
rendered by its transit facilities with the service rendered by the
transit facilities owned or controlled by the Authority in conform-
ance with the policy specified in Section 31
30, or when the Authority
shall determine that the continued existence of any private carrier
would impede the development of a regional transit system or ad-
versely affect its operations or the economic soundness thereof, or
when the Authority otherwise deems it necessary to provide an
adequate regional system, the Authority may, by purchase, lease
or condemnation, acquire, in whole or in part, the assets and prop-
erties, real and personal, including rolling stock, shops, garages and
terminals, and any other property or transit facilities used or useful
in the operation of transit service in the District of any private
carrier or may by purchase acquire the capital stock of any such
private carrier.

38. 37. Operations.

(a) The rights, benefits, and other employee protective condi-
tions and remedies of Section 13(c) of the Urban Mass Transporta-
tion Act of 1964, as amended, (49 U.S.C. 1609 (c)), as determined
by the Secretary of Labor, shall apply to the operation of
