(b)    It shall be unlawful for any person to drive or attempt to
drive or to be in actual physical control of any vehicle within this
State while his driving ability is impaired by the consumption of
alcohol.

(c)    Penalties. Every person who is convicted of violation of sub-
section (a) of this section shall be punished by imprisonment for not
more than one (1) year or by fine of not less than One Hundred Dol-
lars ($100.00) nor
NOT more than One Thousand Dollars ($1,000.00),
or by both fine and imprisonment.

On a second or subsequent conviction, he shall MAY be punished by
imprisonment for not less than six (6) months, nor
NOT more than
two (2) years, and in the discretion of the court, a fine of not more
than One Thousand Dollars ($1,000.00).

(d)    Penalties. Every person who is convicted of a violation of
subsection (b) of this section shall be punished by fine of not less
than Fifty Dollars ($50.00), nor
NOT more than Five Hundred Dol-
lars ($500.00).

On a second or subsequent conviction, he shall MAY be punished by
imprisonment for not less than three (3) months, nor more than one
(1) year, and in the discretion of the court, a fine of not more than
Five Hundred Dollars ($500.00).

Sec. 2. That all laws or part of laws, public general or public local,
inconsistent with the provisions of this Act are hereby repealed to
the extent of any such inconsistency.

Sec. 3. That if the provisions of this Act or the application
thereof to any person or circumstance is held invalid for any reason,
such invalidity shall not affect the other provisions or any other ap-
plication of this Act which can be given effect without the invalid
provisions or application, and to this end, all the provisions of this
Act are hereby declared to be severable.

Sec. 4. And be it further enacted, That this Act shall take effect
July 1, 1969.

AN ACT to repeal Sections 86B, 89, and 96 of Article 66˝ of the
Annotated Code of Maryland (1967 Replacement Volume and 1968
Supplement), title "Motor Vehicles," subtitle "Administration—
Registration—Titling," and to repeal Sections 86, 86A, 87, 88,
90, 91 (A) and 92 of Article 66˝ of the Annotated Code of Maryland
(1967 Replacement Volume and 1968 Supplement), title "Motor
Vehicles," subtitle "Administration—Registration—Titling," and to
enact new Sections 86, 86A, 87, 88, 90, 91 (A) and 92 in lieu thereof,
to stand in the place of the sections repealed; and to add new Sec-
tions 92A and 92B to Article 66˝ of the Annotated Code of Mary-
