Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.
SEC. 2. AND BE IT FURTHER ENACTED, THAT THIS ACT
IS HEREBY DECLARED TO BE AN EMERGENCY MEASURE
AND NECESSARY FOR THE IMMEDIATE PRESERVATION
OF THE PUBLIC HEALTH AND SAFETY AND HAVING BEEN
PASSED BY A YEA AND NAY VOTE SUPPORTED BY THREE-
FIFTHS OF ALL THE MEMBERS ELECTED TO EACH OF
THE TWO HOUSES OF THE GENERAL ASSEMBLY, THE
SAME SHALL TAKE EFFECT FROM THE DATE OF ITS
PASSAGE.

CHAPTER 151
(House Bill 802)
AN ACT to repeal and re-enact, with amendments, Section 115(c) of
Article 66C of the Annotated Code of Maryland (1967 Replacement
Volume), title "Natural Resources," subtitle "Birds, Game and
Inland Water Fish," subheading "Commission," to provide that the
additional penalty shall not apply to game birds and animals, wild
waterfowl and deer, the penalties for which are set forth in Sections
148, 152 and 196 , 196 AND 196A of this article.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 115(c) of Article 66C of the Annotated Code of Mary-
land (1967 Replacement Volume), title "Natural Resources," subtitle
"Birds, Game and Inland Water Fish," subheading "Commission," be
and it is hereby repealed and re-enacted, with amendments, to read
as follows:
115.
(c) It shall be a misdemeanor to violate such regulation adopted
by the Commission or any part thereof, and any person so convicted
of such violation shall be fined not less than twenty-five dollars
($25.00) nor more than one hundred dollars ($100.00) and may be
sentenced to thirty (30) days in jail, either, or both, in the discretion
of the court or justice of the peace before whom said person shall be
tried, and in addition to said fine, shall be fined five dollars ($5.00)
for each and every wild bird, wild animal, or fish illegally killed or
found in possession [.], provided however, the additional penalty
herein provided shall not apply to game birds and animals, wild
waterfowl and deer, the penalties for which are those set forth in
Sections 148, 152 and 196 , 196 AND 196A of this Article. A second
conviction within the same twelve month period for a violation of any
regulation adopted by the Commission shall result in suspension of
the violator's license for a period of twelve months from the date of
such conviction. A copy of any regulations adopted by the Commis-
sion shall be mailed to the clerk of the circuit court who shall make a
record thereof and cause the same to be posted in front of the court-
house of the county.
