other expenses of the Board and of the secretary incurred in the
discharge of their duties, shall be reverted by the treasurer of the
Board to meet the necessary expenses for the ensuing year.

Sec. 16. And be it further enacted by the General Assembly of
Maryland,
That Sections 368 and 370 of Article 43 of the Annotated
Code of Maryland (1957 Edition, 1965 Replacement Volume and
1968 Supplement), title "Health," subtitle "Optometry," be and they
are hereby repealed and re-enacted, with amendments, to read as
follows:

368.

Within thirty days after April 13, 1914, the Governor upon the
recommendation of the Secretary of Health and Mental Hygiene,
shall appoint a Board of Examiners of Optometry for the State of
Maryland. The Board shall be part of the Department of Health
and Mental Hygiene.
The Board shall consist of five persons, not
more than two of whom may be, but not necessarily, physicians. The
Board shall be selected from a list of ten names endorsed by the
Maryland Association of Optometrists. No person shall be eligible
to appointment as a member of said Board unless he has been
engaged in the actual practice of optometry or ophthalmology in the
State of Maryland continuously for five years last past, and a resi-
dent thereof. A vacancy from any cause shall be filled by the Gov-
ernor , upon the recommendation of the Secretary of Health and
Mental Hygiene,
for the unexpired term from a list of three names
submitted by the Maryland Association of Optometrists. Each mem-
ber of said Board shall hold office for a term of two years and until
his successor is duly appointed and qualified.

In the year 1922, of the five persons appointed upon the expira-
tion of the terms of the members appointed in the year 1920, two
shall be appointed for a term of two years and until their successors
shall respectively be duly appointed and qualified and three shall be
appointed for a term of four years and until their successors shall
respectively be duly appointed and qualified. In the year 1924 and
every four years thereafter two persons shall be appointed to said
Board from a list of six names endorsed by the Maryland Associa-
tion of Optometrists; and in the year 1926 and every four years
thereafter three persons shall be appointed to said Board from a
list of nine names endorsed by the Maryland Association of Optom-
etrists. Every member of said Board appointed subsequent to the
above-mentioned appointments of the year 1922, except those ap-
pointed to fill vacancies, shall hold office for a term of four years
and until his successor shall be duly appointed and qualified.

370.

Said Board shall meet within ten days after their appointment
has been made and choose a president, secretary and treasurer from
members thereof and adopt a common seal, and biennially thereafter
shall elect such officers. Each member shall have the power to admin-
ister oaths and take affidavits concerning all matters properly by
said Board, certifying thereto under the h
