Sec. 15. And be it further enacted by the General Assembly of
Maryland,
That Sections 339, 340, 344, and 361 of Article 43 of the
Annotated Code of Maryland (1957 Edition, 1965 Replacement Vol-
ume and 1968 Supplement), title "Health," subtitle "Funeral Direc-
tors and Embalmers," be and are hereby repealed and re-enacted,
with amendments, all to read as follows:

339.

A board composed of ten members is hereby created and estab-
lished, to be known as the State Board of Funeral Directors and
Embalmers of Maryland, to be part of the Department of Health
and Mental Hygiene,
and the powers and duties of the said Board
prescribed.

340.

The Governor, upon the recommendations of the Secretary of
Health and Mental Hygiene,
[by and with the advice and consent of
the Senate,] AND BY AND WITH THE ADVICE AND CONSENT
OF THE SENATE OF MARYLAND shall appoint nine licensed
funeral directors and embalmers, residents of the State of Maryland,
who shall have been actively engaged in their profession for the last
five years immediately preceding their appointment, four of whom
shall be residents of Baltimore City and five residents of the counties,
who, together with the [Director of the State Board] Commissioner
of Health, or some person designated by the said Commissioner
[Director], as an ex officio member, shall constitute the State Board
of Funeral Directors and Embalmers of Maryland, and they shall
take oath prescribed by the Constitution of Maryland. The members
of the said Board shall hold office for a term of four (4) years or
until their successors are duly appointed and qualified; any vacancy
or vacancies occurring in the membership of the said Board ap-
pointed by the Governor [during a recess of the Legislature] shall
be filled by the Governor, ([subject to confirmation by the Senate at
its next session] upon the recommendations of the Secretary of
Health and Mental Hygiene.
AND BY AND WITH THE ADVICE
AND CONSENT OF THE SENATE OF MARYLAND.

344.

The said Board shall meet at least once every year, and may also
hold special meetings as frequently as the proper and efficient dis-
charge of its duties shall require, or when directed to meet by the
Secretary of Health and Mental Hygiene,
at the time and place to be
fixed by the bylaws and rules of the Board. A majority of all the
members of said Board shall constitute a quorum for the transaction
of any and all business of the said Board.

361.

On or before the third Monday of July in each year, the Board
shall make a report in writing to the Governor and to the Secretary
of Health and Mental Hygiene.
The report shall contain a detailed
statement of the receipts and expenditures of the Board for the
fiscal year ending on the last day of June next preceding. Any
balance of money remaining at that time after the payment of the
salaries of
