the attendance of witnesses and production of papers, books, docu-
ments and testimony. In case of the failure of any person to comply
with any subpoena lawfully issued, or on refusal of any witness to
testify to any matter regarding which he may be lawfully interro-
gated, it shall be the duty of the circuit court of any county or the
judge thereof, or of either of the Circuit Court of Baltimore City
or the judges thereof, or of, on application of [any member of the
State Board of Health,] the Secretary of Health and Mental Hygiene,
or his designee, to compel obedience by attachment proceedings for
contempt. Every witness who shall appear before the Secretary or
his designee [Board] by [its] their orders shall receive for his at-
tendance the fees now provided for witnesses in civil cases in courts
of record, which shall be audited and paid by the State in the same
manner as other expenses are audited and paid upon the presentation
of properly verified vouchers. But no witness subpoenaed at the
instance of parties other than the [Board] Secretary or his designee
shall be entitled to compensation from the State for attendance or
travel unless the Secretary or his designee [Board] shall certify that
his or her testimony was material to the matter investigated. Fees
paid under this section shall be charged to the general appropriation
for the Department of Health and Mental Hygiene [State Board of
Health], The [State Board of Health] Secretary or his designee may,
in any investigation, cause depositions of witnesses residing within
or without the State to be taken in the manner prescribed by law for
like depositions in civil actions in courts of record.

The [State Board] Commissioner of Health of Maryland shall
divide the State outside of Baltimore City into twenty-three sanitary
districts following county lines, and, with the approval of the Sec-
retary of Health and Mental Hygiene, he [upon the recommendation
of its Director, and by a majority vote thereof, it] shall appoint a
deputy State health officer for each sanitary district.

The deputy State health officers shall be experienced physicians hav-
ing such [trained in sanitary science and hygiene, and shall possess
the same] qualifications [required of the State health officer, and] in
the field of public health as determined by the Secretary of Health
and Mental Hygiene. The deputy State health officers shall hold their
office during efficiency and good behavior, but may be removed, in
the manner provided in Section 33 of Article 64A, title "Merit Sys-
tem." No deputy State health officer shall practice medicine or en-
gage in any occupation which would conflict with the performance
of his official duties. Each deputy State health officer shall have an
office located at some accessible point designated by the [State Board
of Health,] Secretary of Health and Mental Hygiene, within his
sanitary district, and he shall receive such salary as [it shall |
