the Council shall make the tax levies deemed necessary to finance the
Budget.

Section 306. Item Veto or Reductions

Upon approval of the budget, it shall be delivered within three days
to the County Executive who within ten days thereafter may disapprove
or reduce any item contained in it. If the County Executive disapproves
or reduces any item in the budget, he shall return it to the Council with
the reasons for his disapproval or reduction stated in writing. The Coun-
cil may, by the affirmative vote of four members, reapprove any item over
the disapproval or reduction of the County Executive within thirty days.

Section 307. Supplemental Appropriations

Any supplemental appropriation shall be recommended by the County-
Executive who shall specify the source of funds to finance it. The Council
may make a supplemental appropriation for any purpose on or after Janu-
ary 1 of any fiscal year. Prior to January 1, the Council may make
supplemental appropriation only in order to comply with, avail the County
of, or put into effect the provisions of federal, state or local legislation or
regulations. The Council shall make a supplemental appropriation only
after public hearing on at least one week notice. The procedure for dis-
approval or reduction of a supplemental appropriation by the County
Executive shall be the same as in the case of the budget.

Section 308. Emergency Appropriations

An appropriation containing a declaration of emergency, and stating
that it is necessary to meet an unforeseen disaster or other emergency
and approved by not Jess than five members of the Council, shall be an
emergency appropriation. The Council may make an emergency approp-
riation at any time after public notice by news release. Any emergency
appropriation shall specify the revenues necessary to finance it.

Section 309. Transfer of Funds

The County Executive may at any time transfer an unencumbered
appropriation balance within a division or between divisions of the same
department. Transfers between departments, boards or commissions, or
to any new account, shall be made only by the County Council upon the
recommendation of the County Executive. The total cumulative transfers
from any one appropriation shall not exceed ten percent of the original
appropriation. No transfer shall be made between the operating and
capital budget appropriation.

Section 310. Surplus

The County may accumulate earned surplus in any enterprise fund
or unappropriated surplus in any other fund except that, with respect to
the General Fund, such accumulation shall not exceed five percent of the
General Fund revenue for the preceding fiscal year. Such unappropriated
surplus may be used to fund any supplemental or emergency appropria-
tions.

Section 311. Limitations on Expenditures

No expenditures of County funds shall be made or authorized in
excess of the available unencumbered appropriations therefor.
