listing and financing of housing based on race, color, religious creed,
ancestry or national origin, and to assure equal opportunity for hous-
ing facilities to all persons, co-existent with the intent and purposes
but not necessarily the scope or limitation of the Fair Housing Provi-
sions of the United States Civil Rights Act of 1968; and in accord-
ance with the concepts of conciliation, administrative and constitu-
tional due process authorize the Commission Panel on Housing of the
Montgomery County Commission on Human Relations to administer
and assure enforcement of the provisions of this enactment with its
terms.
BE IT ENACTED BY THE COUNTY COUNCIL FOR MONTGOMERY
COUNTY, MARYLAND, that—
Section 1. There is hereby added to the Montgomery County Code
1965, a new Article, to be known as Article III, Chapter 77, to follow
immediately after Chapter 77, Section 77-12 thereof, and to read as follows:
77-13. Definitions.
For the purposes of this Article:
(a) "Dwelling" means any building, facility or structure, or portion
thereof, which is designed, intended or arranged for use or occupancy as
a home, residence, or sleeping place of one or more individuals.
(b) "Housing" includes any building, facility or structure, or por-
tion thereof, which is used or occupied or is intended, arranged or designed
to be used or occupied as the home, residence or sleeping place of one or
more individuals, groups or families and any vacant land offered for
sale or lease for the construction or location thereon of such building,
facility or structure.
(c) "Commission" means the Montgomery County Commission on
Human Relations.
(d) "Commission Panel on Housing," hereinafter known as Com-
mission Panel, shall consist of at least two members of the Montgomery
County Commission on Human Relations and one member of the commu-
nity at large or an additional member of the Human Relations Commis-
sion, all members to be designated by the Montgomery County Council, of
which one such member shall be the Chairman of the Commission on
Human Relations (the members of the Commission Panel designated by
the Council shall serve at the pleasure of the Council), to carry out the
adjudicatory and enforcement functions pertaining to alleged violations
of this Article, except that said Panel shall not participate in any investi-
gation of an alleged violation before it nor any conciliation proceedings
prior to a public or private hearing on the merits.
(e) "Executive Secretary" includes a member of the County Man-
ager's staff or his designee appointed to serve in this capacity.
(f) "Lending institution" means any bank, insurance company,
savings and loan association or any other person or organization regularly
engaged in the business of lending money or guaranteeing loans.
