police or any other lawful authority, except those public officers and per-
sons assisting them in attempting to disperse the same, shall be deemed
guilty of a misdemeanor punishable as may be provided above.

(d)     The County Council is hereby authorized to enter into any
inter-local agreements with any municipality, county, or state or federal
agency, or with any other private or volunteer association for the mutual
advantage and benefit of the parties thereto, to render such emergency and
supplemental services and fire and police protection as may be necessary
in the event of a fire, disturbance or other local emergency of a magnitude
that has developed or appears to develop beyond the control of one party
and therefore requires the forces of one or all of the other parties thereto.

(e)     If any part, section or subdivision of this Act shall be held
unconstitutional or invalid for any reason, such holding shall not be con-
strued to invalidate or impair the remainder of this Act, which shall
continue in full force and effect notwithstanding such holding.

Section 2. This Act shall take effect August 15,1968.

Chapter 7
(Bill No. 14)

An Act to add new Section 1-7A to Chapter 1 of the Montgomery
County Code, 1965, title "Alternative Method of Enforcement; Notice
of Violation," to follow immediately after Section 1-7 of Chapter 1
of the Montgomery County Code, 1965; to establish an alternative
Notice of Violation procedure for violations of any County resolution,
local law, rule, regulation or ordinance.

BE IT ENACTED BY THE COUNTY COUNCIL FOR MONTGOMERY
COUNTY, MARYLAND, that—

Section 1. That new Section 1-7A of Chapter 1 of the Montgomery
County Code, 1965, title "Alternative Method of Enforcement; Notice of
Violation" be enacted to read as follows:

1-7A.

(a)     Whenever in this Code or in any ordinance, resolution, local law,
rule or regulation of the County any act is prohibited or is made or declared
to be unlawful or an offense, or whenever in such Code or ordinance,
resolution, local law, rule or regulation the doing of any act is required or
the failure to do any act is declared to be unlawful, the violation of any
such provision of this Code or any ordinance, resolution, local law, rule or
regulation may be evidenced by the issuance of a Notice of Violation as an
alternative to arrest or the obtaining of a warrant, for said violation. A
police officer, or an authorized agent of the Department of Inspection and
Licenses, Department of Health or Fire Marshal witnessing a violation
shall be authorized to issue such Notice of Violation to any person when
that alternative will best meet the needs of justice and expediency under
the circumstances providing that the person shall be personally served by
such officer or agent and further that the person consents voluntarily in
writing to accept such notice and to appear in Court as provided herein.
