be discontinued, or otherwise be vacated or transferred, surrendered or
handed-over to a successor in business or conducted under a new name; or
a sale in anticipation of, or in avoidance of termination, liquidation, re-
vision, windup, discontinuation, conclusion, dissolution or abandonment.

Section 2. This Act shall take effect August 15, 1968.

Chapter 5
(Bill No. 11)

An Act to amend Chapter 11, title "Health and Sanitation," of the
Montgomery County Code 1965, by repealing and re-enacting, with
amendments, Sec. 11-13(a), title "Authority to establish service and
disposal plants, contract for collection and removal, etc.," to provide
for the establishment by ordinance and the administration of a spe-
cial service charge area to be known as the "Refuse Collection Dis-
trict" and to provide for the collection of such service charges in the
same manner as ordinary taxes are now or may hereafter be collected.

BE IT ENACTED BY THE COUNTY COUNCIL FOR MONTGOMERY
COUNTY, MARYLAND, that—

Section 1. Section 11-13 (a) (1), Chapter 31, title "Health and Sani-
tation," of the Montgomery County Code 1965, is hereby repealed and
re-enacted, with amendments, to read as follows:

11-13. Authority to establish service and disposal plants, contract for
collection and removal, etc.

(a) The Council may:

(1)    Establish and maintain such service and disposal plants as it
may deem necessary or desirable for the collection and disposal of refuse,
and fix the charges for such service, and to this end the Council may estab-
lish by ordinance and provide for the administration of a special service
charge area to be known as the "Refuse Collection District." All service
charges imposed on property within the said "Refuse Collection District"
shall be collected in the manner in which ordinary taxes are now or here-
after may be collected under the provisions of the general and local laws
of the State and County; and, upon default in the payment of any service
charge, the property against which such service charge has been made
shall be sold at tax sale in the same manner as real property is sold for
non-payment of ordinary taxes;

(2)    License or contract with a contractor to collect and dispose of
such refuse under such regulations as to charges and methods as they
deem advisable;

(3)    Contract for the construction or operation or both of incin-
erators or other disposal plants, to be paid for from charges or otherwise,
and to become the property of the County after such period and upon such
terms as they may prescribe.

Section 2. This Act shall take effect August 15, 1968.
