Chapter 3
(Bill No. 3)

An Act to repeal and re-enact, with amendments, Section 24-43(a)
of the Montgomery County Code 1965, titled "Streets and Roads,"
subtitled "Article III. Abandonment of Roads and Drainage Rights of
Way," so as to provide for a 45 day time limit for recommendations
to the Council from those listed agencies, on proposals for abandon-
ment or closing of roads and drainage rights of way.

BE IT ENACTED BY THE COUNTY COUNCIL FOR MONTGOMERY
COUNTY, MARYLAND, THAT—

Section 1. Section 24-43 (a) of Chapter 24, of the Montgomery County
Code 1965, as amended, is hereby repealed and re-enacted, with amend-
ments, to read as follows:

24-43. By resolution of Council; hearing, recommendations, etc.

(a) Upon application by the Council, any governmental agency, or
any person, roads or storm drainage rights of way may be abandoned
or closed by resolution of the Council adopted in accordance with the re-
quirements of this article. No resolution shall be adopted until after a
hearing has been held by the Council in accordance with the procedures
specified in Section 2-28 of this Code, and until after the council has
received recommendations on the proposal for the abandonment or closing
from the agency or governmental body listed below; provided, however,
that, if such agency or governmental body has not filed its recommenda-
tion with the Council within forty-five days from the date of the applica-
tion, its consent to the proposal shall be presumed:

Section 2. This Act shall take effect August 15, 1968.

Chapter 4
(Bill No. 4)

An Act to repeal and re-enact, with amendments, Section 2-41,
titled "Administration," subtitled "Article IV. Department of Fi-
nance," so as to require that receipts be issued by every officer and
employee receiving money for the county.

BE IT ENACTED BY THE COUNTY COUNCIL FOR MONTGOMERY
COUNTY, MARYLAND, THAT—

Section 1. Section 2-41 of Chapter 2, titled "Administration," sub-
titled "Article IV. Department of Finance," of the Montgomery County
Code 1965, is hereby repealed and re-enacted, with amendments to read
as follows:

2-41. Receipts to be issued for moneys collected; record of receipts and

disbursements.

It shall be the duty of every officer and employee receiving money
for the county to issue a receipt to the person paying the same, showing
the date, purpose and amount of every sum received, except that a bill
marked "Paid" shall be a sufficient compliance with this provision. A
complete file of duplicate receipts shall constitute a valid and sufficient
record of the cash receipts of each county officer or employee. It shall be
the duty of every officer and employee disbursing money for the county
