CUMBERLAND                                          1923

is filed, the Mayor and other proper officials of the City of Cumberland
shall comply with all the provisions set forth in Sections 13 to 17, both
inclusive, of Article 23A of the Annotated Code of Maryland.

Section 5. AND BE IT FURTHER RESOLVED, That as soon as the
Charter Amendment hereby made shall become effective, either as herein
provided for or following a Referendum, the Mayor shall send separately,
by Registered Mail, to the Secretary of the State of Maryland, and to the
Department of Legislative Reference of Maryland, the date of the Refer-
endum if any is held, a complete certified copy of the text of this Resolu-
tion, a certificate showing the number of councilmen voting for and
against it, and a report on the votes cast for or against the amendment
hereby enacted at any Referendum thereon and the effective date of the
Charter Amendment.

This Resolution passed this 26th day of August, 1968.

This Charter Amendment enacted by the aforegoing Resolution be-
came effective this 15th day of October, 1968.

I HEREBY CERTIFY, That the aforegoing Resolution amending the
Charter of the City of Cumberland, Maryland, was passed on the 26th
day of August, 1968, with 4 votes in the affirmative and 0 votes in the

I HEREBY CERTIFY, That the aforegoing is a true and exact copy
of Charter Amendment Resolution No. 38, passed by the Mayor and City
Council of Cumberland, Maryland, in Regular Session on August 26, 1968.

I FURTHER CERTIFY, That there was no Petition for a Referendum
on the proposed amendment filed within the required time, and, therefore,
the same became effective on October 15, 1968.

Charter Amendment Resolution No. 39

Resolution of the Mayor and City Council of Cumberland, Mary-
land, adopted in pursuance of the authority contained in Article 11-E
of the Constitution of the State of Maryland, and Section 13 of Article
23A of the Annotated Code of Maryland, entitled, "Municipal Corpo-
rations," as said Section was enacted by Chapter 423 of the Acts of
the General Assembly of Maryland, 1955, entitled "A Resolution to
amend the Charter of the City of Cumberland, Maryland (1966
Edition), by repealing and re-enacting, with amendments, Subsection
(k) of Section 36 of said Charter, which is found under the Subtitle
'Civil Service-Fire and Police,' and relates to employment require-
ments for members of the Police and Fire Departments."

Section 1. BE IT RESOLVED BY THE MAYOR AND CITY COUN-
CIL OF CUMBERLAND, MARYLAND, That subsection (k) of Section
36 of the Charter of the City of Cumberland (1966 Edition) be and is
hereby repealed and re-enacted, with amendments, to read as follows:

"(k) No person shall be employed in any capacity in the Fire or
Police Department unless he is a citizen of the United States and is of
good moral character and can read and write the English langu
