1922                              MUNICIPAL CHARTERS

Cumberland (1966 Edition), as enacted by Charter Amendment Res-
olution No. 37 passed on the 1st Day of July, 1968, dealing with a
Police Pension Fund and Police Pension Fund Board."

Section 1. BE IT RESOLVED BY THE MAYOR AND CITY COUN-
CIL OF CUMBERLAND, That subsection 2 of Section 53 of the Charter
of the City of Cumberland (1966 Edition), as enacted by Charter Amend-
ment Resolution No. 37 of the Mayor and City Council passed on the 1st
day of July, 1968, be and is hereby amended to read as follows:

"2. Membership. Said Board shall consist of five (5) members, who
shall be the Commissioner of Police and Fire of the City of Cumberland,
[the City Solicitor,] the City Comptroller, the Chief of the Police De-
partment, all of whom shall serve terms coextensive with their terms of
office or employment in such capacity, and one (1) additional member
who shall be selected for a term of three (3) years by a majority of the
eligible members of said Police Department and who may be but need not
be a member of said Police Department who is eligible to participate in
the programs hereby created.
[That member selected as aforesaid may
be, but need not be, a member of said Police Department who is eligible
to participate in the programs hereby created, and must be a resident of
the City of Cumberland.] The fifth member of said Board shall be chosen
by a vote of the four original members of said Board for a term, of four
(4) years and shall not be an elected or appointed official of the City of
Cumberland. However, both the member chosen by the Police Department
and the member chosen by the Board must be residents of the City of
Cumberland.

"Said Board shall elect from its membership a Chairman, Vice-Chair-
man, Secretary and Treasurer, who shall perform the functions usually
performed by such officers."

Section 2. AND BE IT FURTHER RESOLVED, That the date of
the passage of this Resolution is August 26, 1968, and the amendment
of the Charter of the City of Cumberland, hereby enacted, shall become
effective on October 15, 1968, unless a proper Petition for a Referendum
hereon shall be filed as provided by Section 13 of Article 23A of the Anno-
tated Code of Maryland, and provided a complete and exact copy of this
Resolution shall be continuously posted on the North Centre Street en-
trance of the City Hall, Cumberland, Maryland, until October 8, 1968, and
provided further that a fair summary of the proposed amendment shall
be published in the Cumberland Evening Times, a newspaper of general
circulation in the City of Cumberland, once in each of the weeks of
August 26, September 2, 9, 16 and 23, 1968.

Section 3. AND BE IT FURTHER RESOLVED, That the Mayor of
the City of Cumberland is hereby specifically directed to carry out the
provisions of Section 2 hereof, regarding the giving of notice by posting
and publication of this Resolution approving the same, and, as evidence
of said compliance, the City Clerk shall cause to be affixed to the Charter
