CUMBERLAND                                        1909

by repealing and reenacting, with amendments, Section 65, which is
found under the subtitle Towers' and deals with attendance of certain
officers at Council meetings."

Section 1. BE IT RESOLVED BY THE MAYOR AND CITY COUN-
CIL OF CUMBERLAND, MARYLAND, That Section 65 of the Charter
of the City of Cumberland, under the subtitle "Powers," which reads as
follows, be and is hereby repealed:

[The health officer, solicitor, engineer, comptroller and chiefs of the
police and fire departments shall attend all regular meetings of the mayor
and city council and any special meetings of said mayor and city council
at which their presence may be requested by any member of the city coun-
cil. They shall have the privilege of participating in the discussion of
matters relating to their respective departments, but shall have no vote.]

Section 2. AND BE IT FURTHER RESOLVED, That Section 65 of
the Charter of the City of Cumberland (1966 Edition) be and is hereby
reenacted to read as follows:

The City Solicitor and City Engineer shall attend all regular meetings
of the Mayor and City Council and any special meetings of the Mayor
and City Council at which their presence may be requested by said City
Council; provided, however, that the City Solicitor and City Engineer may
be excused from attending any regular or special meeting by said City
Council.

The City Comptroller and the Chiefs of the Police and Fire Depart-
ments shall attend any regular or special meeting of the Mayor and City
Council at which their presence may be requested by said City Council.

Any of the officers herein included shall have the privilege of partici-
pating in the discussion of matters relating to their respective depart-
ments at such regular or special meetings, but shall have no vote.

Section 3. AND BE IT FURTHER RESOLVED, That the date of the
passage of this Resolution is June 10, 1968, and the amendment of the
Charter of the City of Cumberland, hereby enacted, shall become effective
on July 30, 1968, unless a proper Petition for a Referendum hereon shall
be filed as provided in Section 13 of Article 23A of the Annotated Code of
Maryland, and provided a complete and exact copy of this Resolution shall
be continuously posted on the North Centre Street entrance of the City
Hall, Cumberland, Maryland, until July 20, 1968; and provided further,
that a fair summary of the proposed amendment shall be published in the
Cumberland Evening Times, a newspaper of general circulation in the City
of Cumberland, once in each of the weeks of June 10, 17, 24, July 1 and
8, 1968.

Section 4. AND BE IT FURTHER RESOLVED, That the Mayor of
the City of Cumberland is hereby specifically directed to carry out the
provisions of Section 3 hereof, regarding the giving of notice by posting
and publication of this Resolution approving the same, and, as evidence
of said compliance, the City Clerk shall cause to be affixed hereto a certifi-
cate of the publication of the n
