of necessity and charity always excepted), nor shall suffer or permit
any children or servants to profane the Lord's day by gaming, fish-
ing, fowling, hunting or unlawful pastime or recreation; and every
person transgressing this section and being hereof convicted before
a justice of the peace shall forfeit five dollars, to be applied to the
use of the county. Notwithstanding anything to the contrary, the
provisions of this section shall not apply [to Baltimore County.] :

(1)    To Baltimore County, PRINCE GEORGE'S COUNTY, OR
MONTGOMERY COUNTY, or

(2)    To any person who conscientiously believes that the seventh
day of the week ought to be observed as the Sabbath and who
actually refrains from secular business and labor on that day, and
whose business establishment or establishments or employer's busi-
ness establishment or establishments (whether a sole proprietorship,
partnership or corporation) are actually closed on that day; or

(3)    To any person who conscientiously believes that the Sabbath
begins at sundown on Friday night and ends at sundown on Satur-
day night and who actually refrains from secular business and
labor during such period, and whose business establishment or estab-
lishments or employer's business establishment or establishments
(whether a sole proprietorship, partnership or corporation) are
actually closed during such period.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.

(House Bill 711)

AN ACT to repeal and re-enact, with amendments, Section 522 of
Article 27 of the Annotated Code of Maryland (1967 Replacement
Volume and 1968 Supplement), title "Crimes and Punishments,"
subtitle "Crimes and Punishments," subheading "Sabbath Break-
ing," to exempt the application of this section to BALTIMORE
COUNTY, PRINCE GEORGE'S AND MONTGOMERY COUN-
TIES AND TO such persons who conscientiously believe that the
seventh day of the week ought to be observed as the Sabbath or
to such persons who conscientiously believe that the Sabbath begins
at sundown on Friday night and ends at sundown on Saturday night
and who actually refrain from secular business and labor during
such respective periods.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 522 of Article 27 of the Annotated Code of Maryland
(1967 Replacement Volume and 1968 Supplement), title "Crimes and
Punishments," subtitle "Crimes and Punishments," subheading
"Sabbath Breaking" be and it is hereby repealed and re-enacted
with amendments, to read as follows:
