(f)    Any person other than a licensed funeral director and
embalmer who sells or offers to sell any pre-need contract shall be
deemed to be practicing without a license and upon conviction
thereof shall be subject to the fine and/or imprisonment as specified
in Section 359 of the Article.

(g)    Pre-need contracts shall not be subject to the Retail Install-
ment Sales Act nor shall the sale of pre-need contracts by licensed
funeral directors and embalmers be deemed to be the insurance

business.

354.

(c) (14) Failure to refund promptly to the person entitled thereto,
upon proper demand, any payments received under a pre-need con-
tract pursuant to Section 366A.

Sec. 2. And be it further enacted, That this Act shall apply to
contracts entered into on and after the effective date.

Sec. 3. And be it further enacted, That this Act shall take effect
July 1, 1969.

CHAPTER 685
(House Bill 710)

AN ACT to repeal and re-enact, with amendments Section 492 of
Article 27 of the Annotated Code of Maryland (1967 Replacement
Volume and 1968 Supplement), title "Crimes and Punishments,"
subtitle "Crimes and Punishments," subheading "Sabbath Break-
ing" to exempt the application of this section to BALTIMORE
COUNTY, PRINCE GEORGE'S AND MONTGOMERY COUN-
TIES AND TO such persons who conscientiously believe the sev-
enth day of the week ought to be observed as the Sabbath or to such
persons who conscientiously believe that the Sabbath begins at
sundown on Friday night and ends at sundown on Saturday night
and who actually refrain from secular business and labor during
such respective periods.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 492 of Article 27 of the Annotated Code of Maryland
(1967 Replacement Volume and 1968 Supplement), title "Crimes
and Punishments," subtitle "Crimes and Punishments," subheading
"Sabbath Breaking" be and it is hereby repealed and re-enacted with
amendments, to read as follows:

492.

No person whatsoever shall work or do any bodily labor on the
Lord's day, commonly called Sunday; and no person having children
or servants shall command, or wittingly or willingly suffer any of
them to do any manner of work or labor on the Lord's day (works
