that, in addition to the Commissioner of Health, FOR THE CIR-

HEALTH OFFICER FOR the county in which an alleged violation
of this subtitle is found may authorize and direct the prosecution
of the alleged offender.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 703 (b) of Article 43 of the Annotated Code of Mary-
land (1968 Supplement), title "Health," subtitle "Air Quality Con-
trol," be and it is hereby repealed and re-enacted, with amendments,
to read as follows:

703.

(b) No prosecution of any person, firm, corporation, agency, or
entity on a charge of violating this subtitle or any standard, rule or
regulation, notice or order promulgated thereunder, shall be had or
maintained unless, at the initial stage thereof, such prosecution shall
have been authorized and directed by the written order of the
Commissioner of Health or the board of health of DEPUTY STATE

HEALTH OFFICER FOR the county in which the alleged violation

is found, such written order to be filed with the papers in the pro-
ceeding. IF THE DEPUTY STATE HEALTH OFFICER FOR
THE COUNTY IN WHICH THE ALLEGED VIOLATION OC-
CURS, REQUESTS THE COMMISSIONER OF HEALTH FOR
SUCH AN ORDER AND THE ORDER IS NOT ISSUED WITH-
IN 30 DAYS AFTER THE REQUEST, THE DEPUTY STATE
HEALTH OFFICER IS AUTHORIZED TO DIRECT BY WRIT-
TEN ORDER THE PROSECUTION OF THE ALLEGED OF-
FENDER.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.

(House Bill 574)

AN ACT to add new Section 645(e) (C-1) to Article 27 of the Anno-
tated Code of Maryland (1967 Replacement Volume), title "Crimes
and Punishments," subtitle "Venue, Procedure and Sentence," sub-
heading "Sentence and Punishment," to follow immediately after
Section 645(d) (C) to provide that an escape by a prisoner working
under a farm labor plan in Anne Arundel County shall be a mis-
demeanor.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 645(e) (C-l) be and it is hereby added to Article 27
of the Annotated Code of Maryland (1967 Replacement Volume),
title "Crimes and Punishments," subtitle "Venue, Procedure and Sen-
tence," subheading "Sentence and Punishment," to follow immedi-
ately after Section 645(d) (C) thereof and to read as follows:
