(3) Alter materially a certificate of registration with fraudulent
intent.
(4) Use or attempt, to use as a valid certificate of registration a
certificate which has been purchased, fraudulently obtained, counter-
feited or materially altered.
(5) Willfully make a false, material statement in an application
for registration or for renewal of a certificate of registration.
738. Board of Examiner's for Hearing Aid Dealers.
(a) There shall be a Board of Examiners for Hearing Aid,
Dealers. The Board shall consist of five members to be appointed
by the Governor WITH THE ADVICE AND CONSENT OF THE
SENATE. The Governor shall designate one member as Chairman.
(b) Members of the Board shall be residents of this State. One
member shall be a person licensed to practice medicine in this
State and shall hold a certificate of qualification from the American
Board of Otolaryngology. Two members ONE MEMBER shall have
at least four years of paid work experience in audiology, shall hold
a certificate of clinical competence in Audiology from the American
Speech and Hearing Association and shall be a member in good stand-
ing of that association. Two THREE members shall be persons ex-
perienced in the sale of hearing aids, shall possess the qualifications
provided in Section 723(c), and shall be recommended by the Mary-
land members of the Hearing Aid Dealers Association of Maryland,
District of Columbia and Delaware. All persons appointed to the
Board after the date on which the Board first issues a certificate of
license, as provided in Section 725 730 (C), shall be persons who hold
valid certificates of license. No member of the Board shall be a
member or employee of the State Board of Health and Mental
Hygiene, or its departments.
(c) Three members of the first appointed Board shall have terms
of two, three and four years, respectively, and two members shall
serve terms of five years, all dating from after July 1, 1969. Board
members APPOINTED THEREAFTER shall serve terms of five
years.
(d) The members of the Board shall receive a compensation as
may be provided in the budget from time to time.
(e) The Board shall meet at least once a year at a place and time
determined by the members. The Board may also meet at such other
times as it may determine.
739. Powers and Duties of the Board.
The powers and duties of the Board are as follows:
(1) To authorize all disbursements necessary to carry out the
provisions of this subtitle.
(2) To supervise and administer qualifying examinations to test
the knowledge and proficiency of applicants for registration.
(3) To register persons who apply to the Board and who are
