HAS BEEN EXAMINED BY AN OTOLARYNGOLOGIST WITH-
IN THE PREVIOUS NINETY DAYS. IF THE CHILD HAS
NOT BEEN EXAMINED BY AN OTOLARYNGOLOGIST WITHIN
THE PREVIOUS NINETY DAYS, THE PERSON ENGAGING
IN THE FITTING AND SALE OF HEARING AIDS MUST
MAKE A WRITTEN RECOMMENDATION FOR SUCH AN
EXAMINATION PRIOR TO THE FITTING OR SELLING OF
A HEARING AID FOR THE CHILD.

728.    Persons and Practices not Affected.

(a)    This subtitle does not apply to a person while he is engaged
in the practice of fitting hearing aids if his practice is part of the
academic curriculum of an accredited institution of higher education
or part of a program conducted by a public, charitable, or nonprofit
institution or organization which is primarily supported by volun-
tary contributions.

(b)     This subtitle shall not be construed to prevent any person,
who is a medical or osteopathic physician licensed to practice by
the Board of Medical Examiners,
OR IS AN AUDIOLOGIST HOLD-
ING A CERTIFICATE OF CLINICAL COMPETENCE FROM THE
AMERICAN SPEECH AND HEARING ASSOCIATION, from
treating or fitting hearing aids to the human ear.

729.    Qualifications of Applicants for Registration; Fee.

An applicant for registration shall pay a fee of $50 and shall
show to the satisfaction of the Board that he

(1)    Is a person of good moral character.

(2)    Is 21 years of age or older.

(3)    Has an education equivalent to a four-year course in a
standard high school or has continuously engaged in the practice
of fitting hearing aids in this State during the three years preceding

July 1, 1969.

(4) Is free from contagious or infectious disease.

730.    Examination.

(a)    An applicant for registration who is notified by the Board
that he has fulfilled the requirements of Section 729 shall appear
at a time, place and before such persons as the Board may designate,
to be examined by written and practical tests in order to demonstrate
that he is qualified to practice the fitting of hearing aids.

(b)     The Board shall give at least two examinations of the type
prescribed in subsection (a) of this Section in each year, and such
additional examinations as the volume of applications makes
appropriate.

(c)    Every person engaged in the sale of hearing aids on the
effective date of this subtitle shall be licensed and given a license by
the Board without examination, if he shall present satisfactory
evidence to the Board that he is a person of good moral character,
twenty-one years of age or older, and has been in the practice of
selling hearing aids for at least 18
