AN ACT to repeal and re-enact, with amendments, Sections 534J
(b) 1 and 534J (c) 3 and 534J (j) of Article 27 of the Anno-
tated Code of Maryland (1967 Replacement Volume and 1968
Supplement), "Crimes and Punishments," subtitle "Crimes and
Punishments," subheading "Sabbath. Breaking," to redefine the
activities of drugstores and to raise the number of persons
allowed to be employed from three (3) to ten (10) SIX (6) persons
and to eliminate the provisions dealing with second and third
convictions.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 534J (b) 1 and 534J (c) 3 and 534J (j) of Article 27
of the Annotated Code of Maryland (1967 Replacement Volume and
1968 Supplement), title "Crimes and Punishments," subtitle "Crimes
and Punishments," subheading "Sabbath Breaking," be and they are
hereby repealed and re-enacted, with amendments, and to read as
follows:
534J.
(b) Notwithstanding any provision of this section, the opera-
tion of any of the following types of retail establishments is
allowed on Sunday:
1. Drugstores whose [principal] basic business is the sale of
drugs and related items.
(c) Nothing in this section applies to:
1. Farmers
2. Nurserymen
3. Small business with not more than [three (3)] ten (10) SIX
(6) persons on any one shift with the exception of persons or retailers
engaged in the sale of motor vehicles.
(j) Any person, firm or corporation violating the provisions of
this section is guilty of a misdemeanor and, upon conviction, is
subject to the following penalties. [The first] A conviction under
this section is to be punished by a fine not to exceed one thousand
dollars ($1,000.00), [a second conviction is punished by a fine not to
exceed two thousand dollars ($2,000.00), and for a third or subsequent
conviction by a fine not to exceed two thousand dollars ($2,000.00),]
for each employee caused, directed, permitted or authorized to work
in violation of this section.
SEC. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.
