be retained and paid to him upon his discharge.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.

AN ACT to repeal Section 20(n)(10) of Article 95A of the Anno-
tated Code of Maryland (1964 Replacement Volume, and 1968
Supplement), title "Unemployment Insurance Law," subtitle
"Definitions," which section exempted vacation pay, paid under
certain conditions from the definition of wages for all purposes
of the Unemployment Insurance Law; and to repeal and re-enact,
with amendments, Section 20(1) (L) of said Act, to provide that
holiday pay and vacation pay paid or payable to an individual at the
time of layoff or separation from employment or during a period
of unemployment, shall not constitute wages for purposes of de-
termining unemployment and weekly benefit eligibility.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 20(n)(10) of Article 95A of the Annotated Code of
Maryland, (1964 Replacement Volume, and 1968 Supplement), title
"Unemployment Insurance Law," subtitle "Definitions," be and it is
hereby repealed and that Section 20(1) (L) of said Article and sub-
title be and it is hereby repealed, and re-enacted with amendments, to
read as follows:
20.
(1) (L) "Unemployment." An individual shall be deemed "un-
employed" in any week during which he performs no services and with
respect to which no wages are payable to him or in any week of less
than full-time work if the wages payable to him with respect to
such week are less than his weekly benefit amount plus allowances
for dependents. For purposes of this section of the law and for the
purpose of the taking of claims for and the payment of weekly bene-
fits, holiday pay and/or vacation pay earned or accumulated to the
credit of the individual, which is paid at the time of layoff or separa-
tion from employment or during a period of unemployment resulting
from a cause other than vacation or holiday, shall not be considered
wages.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.
