1192                             LAWS OF MARYLAND                       [CH. 490

Section 1. Be it enacted by the General Assembly of Maryland,
That the consent of the State of Maryland and of its several political
subdivisions, and of every department and other agency thereof, is
given to the construction and maintenance of a footbridge across the
waterway known generally as YACHT Basin Channel, at Havre de
Grace, Maryland.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.

CHAPTER 490
(Senate Bill 768)

AN ACT to repeal and re-enact, with amendments, Sections 149-1
(d), 149-J (a), (c), 149-K (c), 149-L (b), and 149-0 (b) of Article
43 of the Annotated Code of Maryland (1965 Replacement Volume
and 1968 Supplement), title "Health," subtitle "Anatomical Gift
Act," and to add new Sections 149-J (d) and 149-J (e) to Article
43 of the Annotated Code of Maryland (1965 Replacement Volume
and 1968 Supplement), title "Health," subtitle "Anatomical Gift
Act," to follow immediately after Section 149-J (c) thereof, to
provide the minimum age of a donor making a gift of a human body
or part thereof; the manner in which such gift may be made; to
provide authorization for the examination of a gift of all or part
of a human body; to provide that the rights of a donee shall be
paramount to the rights of others, except as otherwise provided by
law; to provide the document necessary for an anatomical gift by
a living donor; and to restrict civil liability for unknowingly
violating this Act.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 149-1 (d), 149-J (a), (c), 149-K (c), 149-L (b), 149-0
(b) of Article 43 of the Annotated Code of Maryland (1965 Replace-
ment Volume and 1968 Supplement), title "Health," subtitle "Ana-
tomical Gift Act," be and they are hereby repealed and re-enacted
with amendments; and that new Sections 149-J (d) and 149-J (e)
be and they are hereby added to Article 43 of the Annotated Code of
Maryland (1965 Replacement Volume and 1968 Supplement), to fol-
low immediately after Section 149-J (c), and all to read as follows:

149-I.

(d) [Licensed] Physician or surgeon—means any physician or
surgeon licensed to practice under the laws of this State.

149-J.

(a) Any individual who is over the age of [twenty-one (21) years]
eighteen (18) years of age and who is competent to execute a will
may give all or any part of his body for any one or more of the pur-
poses specified in this subtitle, the gift to take effect after death.
