Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 26A be and it is hereby added to Article 96A of
the Annotated Code of Maryland (1964 Replacement Volume), title
"Water Resources," subtitle "Pollution Abatement," to follow im-
mediately after Section 26 thereof, and to read as follows:
26A.
The responsibility of eliminating the residue of an oil spillage THE
RESPONSIBILITY OF DEVELOPING A PROGRAM, INCLUD-
ING TRAINING, WHICH WOULD ENABLE THE STATE
TO RESPOND TO AN EMERGENCY OIL SPILLAGE IN MARY-
LAND WATERS is that of the Maryland Port Authority in
the Baltimore Harbor area and of the Department of Chesapeake
Bay Affairs in other waters of the State. These agencies shall coor-
dinate the efforts of the various State and local agencies aiding in
the operation and request the aid of the appropriate Federal agencies
if necessary.
26B.
THE MARYLAND PORT AUTHORITY AND THE DEPART-
MENT OF CHESAPEAKE BAY AFFAIRS SHALL CHARGE
AND COLLECT A COMPENSATORY FEE FROM THE PER-
SON RESPONSIBLE FOR THE OIL SPILLAGE. THIS FEE
SHALL COVER THE COST OF LABOR, EQUIPMENT OPERA-
TION, AND MATERIALS NECESSARY TO ELIMINATE THE
RESIDUE OF OIL SPILLAGE AND SHALL BE RETAINED BY
THE AGENCY CHARGING THE FEE.
SEC. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.

(House Bill 50)
AN ACT to repeal Section 15 of Article 96A of the Annotated
Code of Maryland, (1964 Replacement Volume and 1968 Supple-
ment) , title "Water Resources," subtitle "Appropriation of Waters;
Reservoirs and Dams," and to enact new Section 15 in lieu thereof,
to stand in the place of the section repealed, to provide for the
hearings on applications for appropriation of State waters or con-
struction of reservoirs, dams or waterway obstructions.
