Whereas, the Federal Government is authorized by the Water
Supply Act of 1958, Title III, approved 3 July 1958 (Public Law
85-500, 85th Congress, 2nd Session, 72 Stat. 297, as amended by the
Act of 16 October 1963, Public Law 88-140, 88th Congress, 1st Ses-
sion, 77 Stat. 249) to include storage in any reservoir project to be
constructed by the Corps of Engineers to impound water for present
or anticipated future demand or need for municipal or industrial
water; and

Whereas, the State is unable to contract directly with the Federal
Government with respect to the project on the terms proposed by the
Federal Government; and

Whereas, It is the purpose of this Act to provide an instrumen-
tality which will be able to contract with the Federal Government to
provide the non-federal cost share of the project and to allocate the
costs thereof among the beneficiaries of the project in a manner most
equitable and just; now, therefore

Section 1. Be it enacted by the General Assembly of Maryland,
That new Sections 89 to 104 inclusive, be and they are hereby added
to Article 96A of the Annotated Code of Maryland, (1964 Replace-
ment Volume and 1968 Supplement), title "Water Resources," to
follow immediately after Section 88 thereof, to be under the new
subtitle "Maryland Potomac Water Authority," and all to read as
follows:

89. Definitions.

(a)    "Authority" means Maryland Potomac Water Authority.

(b)    "Department" means Department of Water Resources.

(c)    "Federal Government" means the United States of America
or any governmental agency thereof.

(d)    "Potomac River" means the main stem and North Branch of
the Potomac River and its tributaries in those reaches below the
augmented average flow surface level of the main stem and North
Branch.

(e)    "Project" means a federally constructed dam, reservoir, and
appurtenances en the North Branch of the Potomac River, commonly
referred to as the Bloomington Dam Project.

(f)    "Represented Counties" means those counties enumerated in
this subtitle as being within the District.

(g)    "User" means any individual, partnership, association, cor-
poration, municipality, governmental body, or other entity, public or
private, which uses or utilizes water from the Potomac River for
whatever purpose, and without regard to whether or not that water
is consumed, altered, or replaced.

(h) "Non-Maryland User" means a user not assessable by a
represented county.

(i) "initial cost" means that portion of the water supply costs
of the project which non-federal entities must contract to repay prior
