And the Defendt by Samll Worthington his Attorney Comes & Saith

that he is not indebted as Declared for he having pd unto mr Luffe

part of the sd accot, and that he ought not to have his accon it being

Contrary to an Act of Assembly made at ye Citty of St. Maries on

the first day of 7ber 94: wherein it is expressed that no Caps

shall issue for any debt not Exceeding Two hundred pounds

of tobacco & of this he Craves a Non Sute on ye Same & puts

himself upon ye Court Worthington pro Dfendt.

And the plt Saith he hath recd no part or prcell of the debt

declared for & puts himSelf on the Court also. Dent

        And the Dfendt Saith that he hath paid part of ye debt to

        the order of the plt. & puts himSelf on the Court also

~ ~ ~ ~ ~ ~            late of Somerset County Planter was

                                           attached to answer unto John Bishopp

of a plea of debt &ca. And whereupon the Said John Bishopp

by Robert Pirrie his Attorney complaineth that whereas the Said

John Poplewell the eight day of Janry in the year of our Lord

1693/4 at Manokin within the Jurisdiction of this Court by a Certain

Bond with a Condicon which the sd Jno Bishopp under the hand and

Seal of the sd John Poplewell bringeth here into Court the date where

of is the day & year afd, did acknowledge himSelf to be bound

to the sd John Bishopp in the full & just Sum of one thousand pounds

of good Sound Merchantable Porke to be paid to the afd Bishopp him

his Heirs Extors Admrs Assigns or Certain Attorney at of before the 10th

day of November next ensueing the day & date aforesd at Snow hill =

Landing. Nevertheless the sd Jno Poplewell the Said Sum of 1000 pounds

of Porke as afd, did according to the tenour of the sd Bond with A

Condicon as afd to the sd John Bishopp he hath not paid, but hath

hitherto refused & doth Still refuse to pay, although often demanded [to]

the damage of the sd John Bishopp of 2000 pounds of Porke as aforesd &

thereupon he brings this Sute &ca. The Condicon of the aforesaid

Bond is as followeth. / Verte.
