Somerset County Ss. John Taylor of this County planter was Attached to answer unto Capt Jno King & mr. Thomas Jones Admrs of ye goods Chattels & Credits of mr Stephen Luffe decd of a plea of trespass of ye Case &ca And whereupon the Said Thomas by Saml Worthington their Attorney Comes & Saith that the sd John at & and before ye year of or Lord God 1692: at Monokin within the Jurisdiction of this Court became indebted unto the sd Stephen Luffe in ye Just Sum of five hundred & fourty & one half pounds of tobacco as pr a prticular accot here in Court appears, & the sd John being indebted in manner as aforesd did upon himself assume & faithfully promise that ye afd Sum of Tobacco he would well & truely Content & pay & Satisfie when there unto required. Nevertheless the sd John ye sd Tobacco to the Said Stephen in his lifetime hath not paid, nor to the sd John & Thomas Since the death of the sd Stephen to the damage of the sd John & Thomas of one thousand & eighty one pounds of tobacco & thereupon he brings this Sute &ca. Worthington pr Quer pledgs &ca. Jno Doe Rich Roe 1691 John Taylor of Wiccocomocoe Dr to ye Estate of mr Ste. Luffe To the Ball of accots – – – – – – – – 3 1692 To 2 Taxes at 176 pr poll – – – – – – – 352 To tobacco pd mr ffra Jenckins for yw for taxes — 185½ 540½ The 2d Writt being returned Non est Inventus the Decln being read & the accot proved Attachmt was humbly prayed by ye plts Attorney which by the Court was granted to ye sd Debt Declared for with Cost &ca. the plts giving Security according to Law. Whereupon Came the forsd Admrs & their Security Saml Worthington & pr Recognizance jointly & Severally did bind themselves in twelve hundred pounds of tobacco a piece to the sd Taylor (viz) if sd Taylor dft did within a Twelve month & a day either by himself or Attorney & appear to the Originall accon &ca. & plead in barr thereof &ca. that they would be responsible &ca as ye law required &ca. —
Donnock Dennis Plt Alexander McSwaine late of Somerset Alexandr Mackswaine dft} County Mercht. was attached to answer ~ ~ ~ ~ ~ ~ ~ ~ unto Donnack Dennis of ye Same County Planter of plea yt he render unto him ye just Sum of one thousand twenty four pounds of tobacco which from him he unjustly deteineth And whereupon the sd Donnick pr Sam Worthington his Attorney Comes & Saith that whereas the sd Alexander on ye 25th day of Aprill in the year of our Lord God 1691 At Nusswaddox within the Jurisdiction of this Court — became indebted unto the sd Donnock in the just Sum of one thousand — twenty four pounds of tobacco in Caske to be paid at or before ye tenth day of October next ensueing the date of the Said Bill which date is the day & year abovesd Nevertheless the Alexander to the sd Donnock ye sd tobacco according to the tenour of the sd Bill hath not paid but hitherto hath refused to the [great] damage of the sd Donnock of Two thousand fourty Eight pounds
