The Declaracon plea acco^t &ca. being read, y^e matter thoroughly

debated this Court do Award agt the plt with Cost alias Executio

it appearing to the Court that 2000 pounds of tobacco to be the

Quant Morist short of the Credit given &ca. — — —

                                           unto Wm ffausett of an accon of y^e Case

And whereupon the sd William by Sam Worthington his Attorney Comes

& Saith that on or about the last day in the year of o^r Lord God

1694 at Monokin within the Jurisdiction of this Court a [Comunicaton]

was had & moved between the sd William and the sd Edward of &

Concerning Some Sawing Worke, wherein it was agreed between

the afd Wm & Edward that if the sd Wm would pay & deliver –

unto the afd Edward one Cow & Calfe he would saw for him One

thousand foot of plank & Scantling when thereunto required at Sixty

pounds of Tobacco p^r Cent to the value of Seven hundred pounds of tob.

and he William giving Credit to y^e promise of y^e sd Edward the Sd

the sd Cow & Calfe to the sd Edward hath paid & delivered but the Said

Edward y^e afd Sawing Worke hath not done according to Contract

but the Same to doe hath refused although often thereunto required

for which the sd William Saith he is damnified to the Value of four

thousand pounds of tobacco for want of the afd planck & thereupon

he brings this Sute Worthington p^r Que^r plegs &ca Jn^o Doe

And the sd Edward Saith he did not agree for any worke or [Confest]

he hath recd a Cow & Calfe of the sd William as by [ ] here in

Court may appear Dent p^r Defend^t

And the plt Sayes that he did agree with him for worke & Saith that

he hath not recd Satisfaction for y^e Cow & Calfe & of this puts him

Self upon the Court also Worthington pro plt.

The foresd declaracon being read & the issue joyned it is the

And whereupon the sd Lawrence & Sarah his Wife by Robert Pirrie their

Attorney complains that whereas the sd John y^e fifteenth day of 8ber

in the year of our Lord 1684 at Pocomoke within the Jurisdiction of this

Court became indebted unto y^e Sd John White by her Certain Note in y^e

Just Sum of eight hundred ninety & nine pounds of good Sound Mertable

tobacco to be paid to the aforesd White him his Heirs Extors Adm^rs or Assigns
