Charles Tindall dft}                   Charles Tindall of this County was attached to

of a plea of trespass on the Case — And whereupon the sd John by Sam^l

Alexander his Attorney Saith that the Said Charles the 10^th day of Aug.

in the year of our Lord 1694 at Snow hill within the Jurisdiction of

this Court was indebted unto him the Said John in the just and full

Sum of Nine hundred & five pounds of good Sound Merchantable tobacco

it being for & in Consideration of Several goods & Merchandizes by him

from the said John received as by an acco^t of the Said goods here in Court

produced may appear. and the sd Charles unto the sd John in manner

afd being indebted did upon himself assume, & to the sd John faithfully

promise that he the sd Sum of 905 lbs of tobacco to the sd John when he

should be thereunto requested would fully Satisfy & pay . Nevertheless

the Said Charles his promise not regarding but minding & fraudulently

intending the plt to deceive the sd Sum to the sd John hath not paid

although often demanded but hath hitherto refused, and doth

Still refuse to the damage of the sd of 1810 lbs of tobacco & thereof
