Matthew Jones late of this County was attached to answer unto James Round Gentl

of a plea of trespas on y^e Case &ca. - - - - - - And whereupon the sd James

by Peter Dent his Attorney Complains that whereas the sd Matthew the 8^th day of

August in the year of o^r Lord 1693 // at Snow hill within the Jurisdiction of this

Court was indebted to the sd James in the Sum of Six hundred thirty & three lbs

of tobacco being for the ball^c of a Certain acco^t for Sundry goods & Merchandizes

by the sd James to the sd Matthew sold & delivered as by y^e sd acco^t in Court may

appear & the sd Matthew to the sd James in manner afd being indebted did –

assume on himself & to ye Said James faithfully promise that he the Said

Matthew the sd Sum of 633. Pounds of tobacco to the sd James would well and

truely Content & pay Neverthelesse the sd Matthew his promise & assumption afd

not regarding but minding & fraudulently intending him the sd James in this

behalfe to deceive & defraud the Same to the sd James hath not paid but hath

hitherto refused & doth Still refuse to the damage of the sd James of 1000 ^lbs

of tobacco & thereof he brings his Sute &ca.
