Dennis Ohigerty Dfend^t }  Dennis Ohigerty was Attached to

Plea of trespass upon y^e Case //

And whereupon the sd ffra p^r himself Complaineth that whereas the

Said Dennis y^e 14^th day of Aug^o in the year of our Lord 1695 at

Pocomoke within the Jurisdiction of this Court was indebted to

the said ffrancis in the Sum of 524 pounds of tobacco as p^r a p^rticular

acco^t thereof here in Court to be produced may appear & the sd Dennis

to the sd ffrancis in manner afd being indebted did assume upon himSelf

& to the Said ffra faithfully promise that the sd Dennis the sd Sum of 500

twenty four pounds of tob to the Said ffra would well & truely Content & pay

Nevertheless the sd Dennis his promise & assumption afd not regarding

but minding & fraudulently intending him the sd ffra in this behalf to

deceive & defraud of the Sd Sum of five hundred twenty four pounds tob

to him the Sd ffra hath not paid but hath hitherto refused & doth Still

refuse, to the damage of the Said ffra, of one thousand & fourty eight pounds

of tobacco, and thereof he brings this Sute &ca.

Decl being read y^e acco^t proved Attachm^t was Craved agt y^e Dfts goods

&ca. which by the Court was granted giving Security according to Law. —

whereupon Came the sd Jenckins & his Security Cap^t Jn^o King & y^e sd

Jenckins & King did p^r Recogniz in Court confess themselves to be indebted

to y^e sd Ohagerty in the double the Sum & Cost, to be responsible to the

sd Dennis if he app^r & plead &ca as p^r Act of Assembly &ca.

Whereas Complaint has this day been made to this Court Concerning one

Wm Wild (who as Said) was by Covenant made with James Weatherley a

Servant for three years, But he the sd Weatherley Contrary to the foresd

Contract or Covenant hath rejected & put away the sd Wild &ca.

        Ordered by y^e Wor^ll Court abovesd that he the sd James Weatherley

        receive & take into his Care & Custody y^e afd Wm Wild and

        him keep according to the afd Contract or Covenant by them made
