within the Jurisdiction of this Court was indebted to the Said

James in the Sum of five hundred & four pounds of tobacco being

the ballance of a Certain acco^t for Sundry goods & Merchandizes

by the Sd James to the sd Swan Sold & delivered & the sd Swan to

the Said James in manner afd being indebted did assume upon

himself and to the Said James faithfully promise that he the

Said Swan the Said Sum of five hundred & four pounds of tobacco =

Would well & truely Content & pay, Nevertheless the Said Swan his

promise and assumption afd not regarding but minding & fraudulently

intending him the Said James in this behalf to deceive & defraud

the Same to the Said James though often demanded hath not paid

but hath hitherto refused & doth Still refuse to the damage of the

Said James of 1000 pounds of tobacco, & thereof he brings his Sute &ca.
