Maynard late of this County deceased Innholder was attached to answer

unto Joseph Basnet of a plea of debt &ca. - - - - - - ____ - - - - - -

And whereupon the Said Joseph by Rob^t Pirrie his Attorney Complaineth

that whereas James Maynard the 24^th day of March in the year of o^r

Lord 1692/3 at Snow hill within the Jurisdiction of this Court became

indebted unto the Said Joseph in the full quantity of One thousand pounds

of good Sound Merchantable tobacco by his Certain Bill Obligatory which y^e

Said Joseph bringeth here into Court the date whereof is the day & year

aforesd , which aforesd 1000 pounds of tobacco the Said James bound himself

his Heirs Extors & Adm^rs to pay to the sd Joseph him his Heirs &ca. the tenth

day of October next ensueing the date aforesd under the hand & Seal of the

Said James Maynard the sd Hannah Maynard Adm^rx as afd the sd Sum

of 1000 pounds of tobacco hath not paid according to the tenour of the Bill.

afd, but fraudulently & Craftily the sd Sum to tobacco afd hath detained

& refused to pay & doth still refuse to pay although thereunto requested by y^e

Said Joseph to the damage of the Said Joseph of 2000^lilb Of tobaco & thereupon

This Bill bindeth me James Maynard me my Heirs Extors Adm^rs or Assigns

to pay unto Joseph Basnett or his Heirs or Assigns the just Sum of one thousand

pounds of good Sound Mertable tobacco & Caske to be paid by the tenth day of

October next ensueing, & Witness my hand & Seal the 21th day of March

the afd 1000 lb of tobacco (if Assetts) thereupon the Court grants order

accordingly, als Executio.

                                           Truett of plea of debt &ca.

And whereupon the Said John, by Rob^t Pirrie his Attorney Complaineth y^t whereas

the Said John y^e 2^d. day of March, in the year of o^r Lord God 1689 at Snow hill w^thin

y^e Jurisdiction of this Court by a Certain bond with a Condition w^ch the sd Jn^o under

the hand & Seal of y^e sd Jn^o bringeth here into Court y^e date whereof is the day and

year afd, did acknowledge himSelfe to be bound to the sd Jn^o in y^e full & just q^t

of twelve thousand pounds of good Sound Mertable leaf tobacco & Caske Convenient

at Some Convenient Towne or Landing in the afd County at or upon y^e 30^th day

of October next ensueing the date afd, Nevertheless the sd Jn^o Poplewell the said

Sum of 1200 pounds of tobacco afd according to the tenour or the sd Bond afd

to the sd Jn^o Truett he hath not paid , but hath hitherto refused & doth Still refuse

to pay although often demanded to the damage of the sd Jn^o Truett of 24000 =

pounds of tobacco as afd & thereupon he brings this Sute &ca.
