The Condicon of which Recognizance is Such that if the above bound Thomas Powell Constable of BogateeNorten hundred doe forthwith Comply with the late Order of Governr & Counsel for the takeing the list or number of hoggs & Catle and also perfect his List of ye Number of Tytheables within his hundred & the Same returne within Such due time that neither the Justices of this Court nor the Country be thereby damnified that then this Recognizance to be void paying fees otherwayes to be & remaine in full power force & Vertue . – – – – - Ordered that Thomas Powell be released from his Comittment paying fees &ca . – – – – – – – ~ ~ ~ ~ ~ ~ ~ ~ ~ Their Maties agt Somerset County Ss // Thomas Oxford – } The Grand Jury for the body ~ ~ ~ ~ ~ ~ of this County on their Oaths doe present Thomas Oxford of this County for that the sd Thomas Some time in the year of or Lord 1694 at the SeaSide within the Jurisdiction of this Court three hogsheads of tobacco did falsely pack & the Same & the Same did Vend & Sell thereby too Cheat & Cozen the good people of this Province to the decay of trade, the Evil Example of others & the Pease &ca. – – – – – Dent Clk of prsentmts . The Indictment being read the Worll Court Comanded that a Jury of twelve good & lawfull Men Should be impannelled to try the sd Matter betwixt their Maties & the Sd Oxford A List or pannell wherefore by the Sheriff returned as followeth (viz) Samuel Horsey Samuel Showell George Baly, Matt Wallace Benjm Idolett Phillip Askew Junr John Henderson ffra. Joyce Walter Evins , Richd Shockley,Hen. Philips Joseph Staton, 12) who being legally impannelled returned & Sworn having heard the totall prceedings & Evidences Sworn & Examined, received their Charge & are Sent forth. - - - - -and this day viz the day afd the Jurors of the afd Jury being Calld over the plt & dft being Calld the Verdict is [decl] & read as followeth (viz) Wee of the Jury doe find for their Maties Samuel Horsey foreman. Ordered by the Court that the plt be reimburst the quantity formerly recd in full weight with adition of eight pr cent Comon psallory & that for his Crime to their Maties the Sd dft to receive thirty lashes upon his bare back well laid on viz 10 for each hogshead to be inflicted three Several Court dayes to wit, now & at ye next ensueing Court dayes . – Ordered that the sd Oxford give good Security for the prformance of the abovesd Order & to be of the good behaviour &ca. - - - Whereupon Came the Sd Oxford & his two Securities Robert Pirrie & Wm Bensom and the Sd Oxford did by Recognizance acknowledge & Confess him Self to be indebted to their Maties the just Sum of one hundred pounds Sterling money of England & the sd Pirrie & Densom in the Sum of fifty pounds apiece like money afd all due to be levyed on their goods and
