(J) WHEN A COMPLAINT IS RULED TO HAVE NO MERIT
BY THE COMMISSIONER AFTER PETITION TO HIM AS SET
FORTH IN SUBSECTION (I), A COMPLAINANT, UNDER SUB-
SECTION (A) ONLY, MAY APPEAL SUCH FINDING TO A
COURT OF EQUITY IN ANY COUNTY WHERE THE EM-
PLOYER, LABOR UNION, EMPLOYMENT AGENCY OR ANY
REPRESENTATIVE THEREOF IS LOCATED WITHIN THIRTY
(30) DAYS OF THE DATE OF THE COMMISSIONER'S RULING.
IF THE COURT FINDS AN ABUSE OF DISCRETION BY THE
COMMISSIONER IN TERMINATING THE CASE, IT SHALL
ORDER SUCH FINDING STRICKEN AND IT SHALL FURTHER
ORDER WHATEVER RELIEF IT DEEMS APPROPRIATE UN-
DER THE CIRCUMSTANCES OF THE CASE SO LONG AS SUCH
RELIEF IS CONSISTENT WITH THE PROVISIONS AND PUR-
POSES OF THIS SUBTITLE.
80C.
Whoever shall (1) forcibly resist, oppose, impede, intimidate, or
interfere with a duly authorized representative of the Commissioner
while he is engaged in the performance of duties under this subtitle
or (2) willfully commit a practice made unlawful by this subtitle
shall be deemed to have been guilty of a misdemeanor and punished
by a fine of not more than $500. or by imprisonment for not more
than one year, or by both: Provided, however, That no person shall
be imprisoned under this section except when there has been a prior
conviction hereunder.
80D.
For the purposes of this subtitle—
(a) The term "person" means one or more individuals, partner-
ships, associations, labor organizations, corporations, business trusts,
legal representatives, or any organized groups of persons.
(b) The term "employer" does not include a club exclusively
social, or a fraternal, charitable, educational or religious associations
or corporation, if the club, association or corporation is not organ-
ized for private profit or any person, company or corporation en-
gaged in interstate transportation whose employment practices are
regulated by federal statute or regulation.
(B) "EMPLOYER" INCLUDES ANY INDIVIDUAL, PART-
NERSHIP, ASSOCIATION, CORPORATION, BUSINESS TRUST
OR ANY PERSON OR GROUP OF PERSONS EMPLOYING ONE
OR MORE EMPLOYEES AT ANY ONE TIME.
(c) The term "Commissioner" means the Commissioner of Labor
and Industry;
(d) The term "employment agency" includes any person, firm or
corporation undertaking to procure employees, or opportunities to
work.
(e) The term "labor organization" means a labor organization
engaged in an industry in the State of Maryland, and any agent
of such an organization, and includes any organization of any kind,
any agency, or employee representation committee, group, associa-
