129. Disbursement of funds; sale of licenses by persons engaged in
retail business.
(a) Disbursement of funds.—The clerks of the circuit courts of
the counties and the clerk of the Court of Common Pleas of Baltimore
City shall on the first day of July and on the first day of each and
every month thereafter, transmit to the Department of Game and
Inland Fish [Commission] of this State all monies received by them
for licenses, and said monies shall be accounted for by the said
[Commission] Department to the [Comptroller of this State]
Treasurer. The amounts so received by the [Comptroller] Treasurer
shall be placed to the credit of a separate fund to be known as "the
State Game Protection Fund," and shall be [disbursed] paid by the
[Comptroller from time to time] Treasurer on warrant[s] of the
Comptroller upon requisition of the Department of Game and Inland
Fish [signed by the Director and countersigned by a representative
of the Commission]. The monies in said fund shall be used solely
for salaries and the expenses of the Department of Game and Inland
Fish and Commission, the Director and his subordinates, and for
scientific investigation and the protection and propagation of birds,
wild fowl, inland fish, and game. The Game and Inland Fish Com-
mission shall require the Director to file an annual account with it
showing the entire receipts and disbursements of himself and all
[deputies] Wildlife Officers and exhibit vouchers therefor and also
shall require the Director to be covered by a surety bond in accord-
ance with the provisions of Sections 46 through 50 of Article 78A
of the Annotated Code of Maryland.
(b) Sale of licenses by persons engaged in retail business.—Any
person engaged in a retail business (except where distilled spirits
are sold for consumption on the premises) desiring to sell hunting
licenses under the control and supervision of the Department of
Game and Inland Fish shall present to the Department a certified
check, postal money order, bank draft or cash or other check as
approved by the Department covering all licenses so desired by them.
Under no circumstances will the Department be compelled to issue
less than the following hunting licenses:

5 Nonresident
All agents shall designate the location where the licenses are to
be sold and shall file said information with the Department at the
time of purchase of licenses.
The agent shall agree to submit the necessary reports of sales
together with the duplicate stubs after the first day of each and
every month thereafter as long as he sells these licenses in accord-
ance with Sec. 126 and said report and stubs shall reach this office
not later than the seventh day of each succeeding month.
The Department of Game and Inland Fish shall credit all author-
ized agents with all monies paid for hunting licenses and shall credit
them with all licenses and tags returned by them which have not
been issued and remain intact only in the books and return to such
agent the money received for all unused or voided licenses. The agent
