126A. Big game stamp required to hunt deer [.] and turkey.
(a) Additional to license; exemption.—All persons hunting deer
and turkey in the State of Maryland must first procure a big game
stamp to so hunt, shoot or kill. The stamp is required in addition to
the regular season license for hunting of other game, except that no
stamp is required of persons who may hunt without a license as
provided in Section 128 of this article.
(b) By whom issued; fee.—The big game stamp may be ob-
tained from the clerks of the circuit courts of the counties, the clerk
of the Court of Common Pleas of Baltimore City, and from duly
authorized agents of the Department of Game and Inland Fish
[Commission]. The cost for a big game stamp [, firearms only,]
is [two dollars ($2.00)] five dollars ($5.00). AND FIFTY CENTS
($5.50). [; and for bow and arrow only, three dollars ($3.00).]
RESIDENTS OF THE STATE OF MARYLAND HAVING AT-
TAINED THEIR SEVENTIETH (70TH) BIRTHDAY MAY OB-
TAIN A FREE BIG GAME STAMP BY APPLYING TO THE
DEPARTMENT OF GAME AND INLAND FISH. The clerk or
agent shall retain as compensation for issuing each stamp the sum
of twenty-five cents ($.25) FIFTY CENTS ($.50), and the balance
of the fee is paid over and accounted for in the manner provided
for under Sections 129 and 130 of this article.
127. Effect of license; hunters to carry license.
Every license so issued shall entitle the person to whom it is issued
to hunt game which is protected by law and for nonresidents to hunt
wild birds and wild animals, in addition to the aforementioned game
birds and game animals and fur-bearing animals in any county with-
in the State at any time during the lawful open season, provided that
every licensee while hunting as aforesaid shall have upon his person
the license referred to above and EVERY LICENSEE, WITH THE
EXCEPTION OF THOSE HUNTING WILD WATERFOWL, shall
display a tag bearing his license number in figures at least one inch
in height fastened upon his outer garment in such manner that the
figures are visible FROM THE REAR at all times while hunting.
The license must be produced for the inspection of the Director,
[game warden] Wildlife Officer, sheriffs, constables, or other officers
or any landowner or [tenant] his representative demanding to see it.
128. Who may hunt without license.
The owner of farmlands, his children or spouses of children, or
tenants, or children or spouses of children of such tenants residing
on said farmlands shall, without procuring such license, have the
right to hunt said enumerated game during the open season for the
same on the said farmlands of which he or they are bona fide owners,
children or spouses of children of such owners, or tenants, or children
or spouses of children of such tenants. The term "tenant" shall
mean a person who holds land under a lease, or as a sharecropper,
and resides in a dwelling on the farm or lands, but shall not include
any employee of either the owner or the tenant. [Provided that in
Frederick County a regularly employed month-hand who is employed
by the owner or tenants of farmlands and who is a resident and
voter in Frederick County shall have the same privileges as a ten-
ant.]
