The term "urban area" as used herein means an area including
and adjacent to a municipality or other urban place having a popu-
lation of five thousand or more, as determined by the latest available
Federal census, within boundaries to be fixed by the State Roads
Commission.

(e) [(h-2)] The State Roads Commission, with the approval of
the municipality or urban area as the case may be, and with the
consent of the Governor and under the provisions of Section 8 of
Article 15A may, in any fiscal year, transfer from the Construction
Fund prescribed in this section to a "Municipality-Urban Area
Highway Construction Fund," which is hereby established, a sum
equal to such amount of Federal-Aid Urban Highway Funds that
may become available from the Bureau of Public Roads and that
may be allocated by the State Roads Commission to the several
municipalities and urban areas and that may subsequently be re-
leased by such municipalities and urban areas to the State Roads
Commission for use on the State Highway System. Such Municipal-
ity-Urban Area Highway Construction Fund shall be subject to
apportionment by the State Roads Commission and matching con-
struction funds shall be required of each such municipality and ur-
ban area participating in such program. Such Municipality-Urban
Area Construction Fund and such matching funds shall be ex-
pended only for highway construction and reconstruction projects
under such rules and regulations as the Commission shall determine.

33.

[Thirty percent of the monies paid into the Gasoline Tax Fund
during any fiscal year, together with the funds added thereto pur-
suant to Section 38 (2) of this article, shall be distributed monthly
to the mayor and city council of Baltimore to be used for the con-
struction, reconstruction or maintenance of the streets and high-
ways of the City of Baltimore, and (for the fiscal years of 1968 and
1969 only) for defraying the costs of the police department of Balti-
more City incurred in connection with the management and control
of vehicular traffic in Baltimore City, not to exceed the sum of four
million dollars ($4,000,000). In each of these two fiscal years or for
the payment of debt service with respect to bonds or other evidences
of debt heretofore or hereafter issued by the City of Baltimore for
the construction, reconstruction or maintenance of streets and high-
ways of the City of Baltimore, and for no other purposes, except as
provided in Section 33A of this article.]

The monies distributed to Baltimore City under the provisions of
Section 38A shall be used (1) for the construction, reconstruction or
maintenance of the streets and highways of the City of Baltimore,
(2) to pay the costs of the Baltimore City Police Department for
carrying out traffic functions and enforcing the traffic laws; (3) to
pay the costs incurred in other highway related activities of such
City in lighting highways, providing for storm water drainage of
said highways, and providing for street cleaning not to include the
cost of collection of garbage, trash and refuse, and (4) for the pay-
ment of debt service with respect to bonds or other evidences of
debt heretofore or hereafter issued by the City of Baltimore for the
construction, reconstruction or maintenance of streets and highways
in the City of Baltimore, and for other highway activities of such
City including the cost of lighting of the highways and the cost of
