Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 5, 14, 27 and 29(6) of Article 97 of the Annotated
Code of Maryland (1964 Replacement Volume and 1967 Supplement),
title "Weights and Measures," subtitle "Standard Weights and
Measures," be and they are hereby repealed.
Sec. 2. And be it further enacted, That Sections 7, 9, 13, 26 and
34(b) of the said Article and subtitle of the Code, be and they are
hereby repealed and re-enacted with amendments to read as follows:

The Superintendent shall issue from time to time reasonable regu-
lations for the enforcement of this subtitle, which regulations shall
have the force and effect of law. These regulations may include
(1) standards of net weight, measure, or count, and reasonable
standards of fill, for any commodity in package form, (2) specifica-
tions and tolerances and other technical requirements for weights
and measures of the character of those specified in Section 9 desig-
nated to eliminate from use, without prejudice to apparatus which
conforms as closely as practicable to the official standards, those
which are not accurate, which are of such construction that they are
faulty—that is, which are not reasonably permanent in their adjust-
ment or will not repeat their indications correctly—or which facili-
tate the perpetration of fraud, and (3) regulations governing the
procedures to be followed by city and county sealers of weights and
measures in the discharge of their official duties. Provided, that the
specifications, tolerances, and other technical requirements for com-
mercial weighing and measuring devices shall be those adopted by
the National Conference on Weights and Measures and included in
the National Bureau of Standards Handbook 44, and subsequent
editions, amendments and revisions thereto effective when officially
published from time to time by the National Bureau of Standards;
such specifications and tolerances shall remain in effect unless modi-
fied or rescinded by regulation duly promulgated by the superin-
tendent, and the superintendent may promulgate additional regula-
tions and amend or rescind any effective regulation. For the pur-
poses of this subtitle apparatus shall be deemed to be correct when
it conforms to all applicable requirements promulgated as specified
in this section; other apparatus shall be deemed to be incorrect.

When not otherwise provided by law, the Superintendent shall
have the power to inspect and test, to ascertain if they are correct,
all weights and measures kept, offered, or exposed for sale. It shall
be the duty of the Superintendent, except in cities and counties for
which the appointment of a sealer of weights and measures is re-
quired by this subtitle, [at least annually and as much oftener] as
often as he may deem necessary, to inspect and test, to ascertain if
they are correct, all weights and measures commercially used (1) in
determining the weight, measurement, or count of commodities or
things sold, or offered or exposed for sale, on the basis of weight or
of measure, (2) in computing any charge or payment for services
rendered on the basis of weight or of measure, or (3) in determining
weight or measurement when a charge is made for such determina-
tion. The Superintendent shall, from time to time, weigh or measure
and inspect packages or amounts of commodities kept, offered, or
