(House Bill 1271)
AN ACT to repeal and re-enact, with amendments, Section 132 of
the Code of Public Local Laws of Charles County, (1965 Edition,
being Article 9 of the Code of Public Local Laws of Maryland),
title "Charles County," subtitle "Hucksters," to specify the stu-
dents exempt from the Charles County huckster licensing provi-
sions and to provide penalties for violating these provisions.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 132 of the Code of Public Local Laws of Charles
County, (1965 Edition, being Article 9 of the Code of Public Local
Laws of Maryland), title "Charles County," subtitle "Hucksters,"
be and it is hereby repealed and re-enacted, with amendments, to
read as follows:
132.
(a) No person shall sell, or solicit orders for sale of, any merchan-
dise of any description, including books or periodicals, from door-to-
door of private residences, without a license. Provided, however,
that this section shall not apply to farmers or growers selling their
own vegetables or other perishable farm produce or products or to
any person regularly attending school in Charles County who is under
the age of eighteen (18) years and who is selling or soliciting pur-
suant to a program authorized by any Charles County school, or to
vendors of milk or cream, bread, meat, fuels of petroleum products,
fish or other seafood, or newspapers. It shall be the duty of the
Clerk of the Circuit Court of Charles County to issue huckster
licenses to such persons as may apply for and be entitled to same
according to the provisions of this section and the amount so re-
ceived shall be paid to the County Commissioners of Charles County
and be credited to the general funds of the County.
(b) Each applicant for such license shall pay annually a licens-
ing fee of one hundred dollars ($100.00) or twenty-five dollars
($25.00) for a one-day license for the day designated. Such license
upon issuance shall not be transferable. The application for such
license shall contain the following information concerning the appli-
cant: Name; address; name and address of employer, if not self-
employed; age; color of skin; color of eyes; color of hair; height;
weight; and, general description of type of merchandise to be sold.
Any person violating the provisions of this section shall be guilty of
a misdemeanor and subject to a fine of not less than twenty-five
dollars ($25.00) nor more than one hundred dollars ($100.00).
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1968.
