CHAPTER 110
(Senate Bill 481)

AN ACT to repeal and re-enact, with amendments, Sections 359 (c)
and 360 of the Code of Public Local Laws of Allegany County
(1963 Edition, being Article 1 of the Code of Public Local Laws
of Maryland) title "Allegany County," subtitle "LaVale Zoning
District," to provide that members of the La Vale Zoning Board
be provided with funds to cover the expenses incurred in the
performance of their duties and to further provide that appeals
from such zoning board to the Circuit Court for Allegany County
need not be heard de novo by the Court.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 359 (c) and 360 of the Code of Public Local Laws of
Allegany County (1963 Edition, being Article 1 of the Code of Public
Local Laws of Maryland), title "Allegany County," subtitle "LaVale
Zoning District," be and they are hereby repealed and re-enacted,
with amendments, to read as follows:

359.

(c) The election of a member to said Board in the 1958 general
election, and all subsequent elections, shall be upon the same terms
and conditions as set forth above, and also shall be conducted by the
Board of Election Supervisors of Allegany County simultaneously
with the balloting for all other elective offices. At all these subsequent
elections, beginning with the election of 1958, all candidates for
office must have their petitions fully certified and presented to the
Chairman of the Board of Election Supervisors at least sixty (60)
days prior to such election. The person elected to office at the 1958
election shall hold office for a period of six years. In a similar man-
ner, the member elected to serve until 1960 shall be replaced or re-
elected at the 1960 election, and the candidate elected to serve until
1962 shall be replaced or re-elected at the 1962 election. Thereafter
members of the Board whose terms expire shall be replaced or re-
elected every two years for a term of six years. The Chairman of
the Board shall be chosen by its members after each general election.
Members of the Board shall serve without compensation [.] , but
shall be provided with funds to cover the expenses incurred in the
performance of their duties.
In the event of the removal from office
of any member, or his failure to qualify, or his death in office, or for
his inability to serve for any reason whatsoever, this subtitle shall
not fail for want of a member of the Board, but in all such cases the
Board of County Commissioners for Allegany County shall appoint a
person to serve as a member of the Board to fill the unexpired term
of the member of the Board. In the event that the original Board
cannot or is not for any reason whatsoever elected at the June 18,
1957, referendum and election, the Board of County Commissioners
of Allegany County shall appoint the entire Board as aforesaid. The
La Vale Zoning Board shall exercise such duties, powers and authority
as may be necessary and advisable for the proper administration and
enforcement of this subtitle.

360.

Any person, persons, taxpayer or officer of the District, jointly or
severally aggrieved by any decision of the La Vale Zoning Board
