COMMISSION ON THE AGING

(a) Six members of the Commission shall be, ex officio, the
Director of the State Department of Health, the Commissioner of
the Department of Mental Hygiene, the Director of the State De-
partment of [Public Welfare] Social Services, the State Superin-
tendent of Schools, the Executive Director of the Department of
Employment Security, and the Director of the State Planning De-
partment.
ARTICLE 88A
State Department of [Public Welfare] Social Services.
1. Department established; State Board of [Public Welfare]
Social Services.
(a) There is hereby created and established a new State De-
partment, to be known as the "State Department of [Public Wel-
fare] Social Services," hereinafter referred to as the "State Depart-
ment." There shall be a "State Board of [Public Welfare] Social
Services," hereinafter referred to as the "State Board," composed
of nine members appointed by the Governor, one of whom shall be
designated by the Governor as chairman. All members of the State
Board shall hold office for terms of six years, the terms of three
members expiring on June 30 of every second year. The members
of the State Board who are in office on July 1, 1967 shall continue
in office until the expiration of their respective terms. In case of
a vacancy for any reason, the Governor shall appoint a member for
the remainder of any unexpired term. The members of the State
Board shall receive no salary for their services, but their reasonable
expenses incurred in attending meetings or performing other of-
ficial duties shall be paid.
(b) The State Board shall determine basic [public welfare]
social service and public assistance policies and rules and regulations
relative thereto consistent with and in implementation of federal
and State law governing the administration of [public welfare
activities] social services and public assistance financed in whole
or in part by the State Department [of Public Welfare]; and it
shall otherwise advise and counsel the State Director of [Public
Welfare] Social Services who shall be appointed as hereinafter pro-
vided in the performance of his duties. The State Board's respon-
sibility for policy shall be construed to extend to such matters as
program scope, eligibility standards, levels of assistance, intergovern-
mental relations and other facets affecting the basic public interest.
The State Board, however, shall exercise no administrative author-
ity dealing with the activities and personnel of the State Depart-
ment, except as provided in subsection (c) hereof.
(c) The State Board may prescribe the number, salaries and
minimum qualifications of all of the personnel engaged in the ad-
ministration of the activities of the State Department and of the
local [welfare] departments of social services (hereinafter referred
to as "local departments"), created or continued under the provi-
sions of Section 13 of this article, as are financed in whole or in
part by the State Department [of Public Welfare].
