(h) No person shall operate a motorcycle as defined in this
Article on any highway of this State unless its speed capability is at
least equal to the posted speed limit on the highway, and the motor-
cycle can meet all other safety requirements such as, brakes, lights
muffler, etc.
(i) (H) A violation of any provision of subsections (g) and (h)
is a misdemeanor, punishable upon conviction by a fine of not less than
ten dollars ($10.00) or more than one hundred dollars ($100.00) for
each such violation.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1968.

AN ACT to repeal and re-enact, with amendments, Section SEC-
TIONS 122 AND 123 of Article 27 of the Annotated Code of
Maryland (1967 Replacement Volume AND 1967 SUPPLEMENT),
title and subtitle "Crimes and Punishments," subheading SUB-
HEADINGS "DISTURBANCE OF THE PUBLIC PEACE" AND
"Drunkenness and Disorderly Conduct," RESPECTIVELY, TO
ELIMINATE THE OFFENSE OF BEING FOUND DRUNK, to
re-define the criminal charge of drunk and disorderly conduct, to
establish procedures for law enforcement officers in their contacts
with intoxicated persons; to provide for habitual offenders; and
to set out the penalties for violating this section. TO MAKE PRO-
VISIONS AS TO PUBLIC PLACES AND PUBLIC CONVEY-
ANCES; TO SET OUT THE PENALTIES FOR VIOLATION OF
SECTION 123; TO PROVIDE FOR THE COMMITMENT OF
CERTAIN HABITUAL INTEMPERATE OFFENDERS FOR
TREATMENT; AND GENERALLY RELATING TO DRUNK-
ENNESS AND DISORDERLY CONDUCT IN THE STATE.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section SECTIONS 122 AND 123 of Article 27 of the Anno-
tated Code of Maryland (1967 Replacement Volume AND 1967 SUP-
PLEMENT), title and subtitle "Crimes and Punishments," sub-
heading SUBHEADINGS "DISTURBANCE OF THE PUBLIC
PEACE" AND "Drunkenness and Disorderly Conduct," RESPEC-
TIVELY, be and the same is are hereby repealed and re-enacted, with
amendments, and to read as follows:
